環 境 保 護 署 ( 環 保 署 )- 循 環 再 用 服 務
合 約 的 批 出 與 管 理
自 二 零 零 三 年 起 , 環 保 署 推 展 多
項 計 劃 , 將 棄 置 的 電 腦 和 電 器 循 環 再
用 。 該 署 以 局 限 性 招 標 方 式 , 將 循 環 再
用 的 服 務 合 約 批 予 兩 間 承 辦 商 。 按 照 合
約 規 定 , 該 兩 間 承 辦 商 必 須 履 行 一 系 列
的 任 務 , 包 括 維 持 一 支 工 作 隊 伍 , 向 捐
贈 者 收 集 電 腦 及 電 器 ( 每 年 的 目 標 為
25,000 台 電 腦 和 15,000 部 電 器 ); 設 立
條 碼 電 腦 系 統 來 控 制 存 貨 ; 以 及 維 修 收
集 回 來 的 電 腦 和 電 器 , 並 分 發 予 有 需 要
人 士 作 循 環 再 用 。
研 究 指 出 , 承 辦 商 回 收 和 處 理 捐
贈 物 品 的 程 序 容 易 出 現 舞 弊 行 為 , 例 如
員 工 盜 竊 等 。
防 貪 處 建 議 環 保 署 應 檢 討 合 約 的
範 圍 和 服 務 要 求 , 確 保 可 切 實 執 行 ; 並
且 , 環 保 署 亦 應 透 過 公 開 競 投 程 序 甄 選
承 辦 商 ; 並 向 承 辦 商 提 供 指 引 和 加 強 監
察 , 確 保 他 們 設 立 良 好 的 管 控 機 制 。
食 物 環 境 衞 生 署 ( 食 環 署 )- 小 販 事 務
隊 的 工 作
小 販 行 業 在 香 港 存 在 已 久 , 他 們
擺 賣 時 , 不 單 經 常 對 市 民 構 成 滋 擾 , 亦
引 起 不 少 環 境 衞 生 問 題 。 根 據 法 例 , 任
何 人 士 在 公 眾 地 方 擺 賣 , 必 須 領 有 食 環
署 發 出 的 牌 照 。 為 遏 止 無 牌 販 賣 活 動 ,
食 環 署 在 轄 下 19 個 分 區 環 境 衞 生 辦 事
處 , 均 設 有 小 販 事 務 隊 , 負 責 巡 邏 及 掃
蕩 等 職 務 。 此 外 , 該 署 在 三 個 總 區 內 亦
各 設 有 一 隊 特 遣 隊 , 負 責 執 行 獨 立 的 掃
蕩 行 動 。 由 於 近 年 出 現 多 宗 有 關 小 販 管
理 的 貪 污 投 訴 , 防 貪 處 遂 檢 討 小 販 事 務
隊 的 工 作 程 序 。
審 查 報 告 指 出 , 食 環 署 人 員 對 在
公 眾 地 方 擺 賣 造 成 阻 礙 的 小 販 , 會 先 行
口 頭 警 告 , 才 予 以 檢 控 , 但 就 該 署 人 員

Efficiency Unit – Outsourcing Services
Involving Non-Skilled Workers
There has been rising public concern
about exploitation of non-skilled workers,
including illegal deduc tion of wages, by
government contractors. Government has, since
2004, required its contractors to pay non-skilled
workers wages no less than the average market
wages published by the Census and Statistics
Department. There is also a Demerit Point System
(DPS) to "penalise" contractors who are found
to have been in breach of this requirement or
convicted of specific employment related offences.
In view of the public concern and a number
of ICAC cases, we conducted a service-wide
review of the government practices in outsourcing
services which involve non-skilled workers.
The study noted that different departments
adopted different practices in handling complaints
lodged by workers, and the sanctions against
contractors who had exploited workers were
not sufficiently punitive to serve as an effective
deterrent. To inspire workers' confidence in the
complaint handling mechanism, we recommended
that outsourcing departments should set up a
task force to investigate complaints in a credible
manner. We further recommended that heavier
sanctions should be imposed under the DPS
for serious offences or contractual breaches to
enhance its deterrent effect, and the contractors
should be required to commit to ethical practices.
Environmental Protection Department (EPD)
– Letting and Administration of Recycling
Service Contracts
EPD has launched a number of pilot
programmes since 2003 for the recycling of
waste computers and electrical appliances.
Through restricted tenders, EPD has appointed
two contractors to undertake the recycling work.
Under these contracts, the two contractors are
required to perform a wide range of tasks. These
include maintaining a team of site staff, collecting
computers and appliances from donors (with an
annual target of 25,000 computers and 15,000
appliances), operating a bar-code system for stock
