委 員 會 認 為 在 過 去 數 年 舉 行 的 各
級 選 舉 , 一 般 都 在 秩 序 井 然 和 廉 潔 的 情 況
下 進 行 。 不 過 , 我 們 關 注 到 規 管 鄉 村 選 舉
方 面 的 法 例 仍 見 不 足 。 委 員 會 已 促 請 政 府
將 村 代 表 及 鄉 事 委 員 會 , 分 別 納 入 《 防 止
賄 賂 條 例 》 中 所 指 的 「 公 職 人 員 」 及 「 公
共 機 構 」 類 別 , 並 規 定 將 來 的 鄉 事 委 員 會
選 舉 須 受 法 例 規 管 。 民 政 事 務 局 轄 下 一 個
跨 部 門 工 作 小 組 現 正 檢 討 有 關 事 宜 。
結 語
過 去 一 年 間 , 委 員 會 各 成 員 對 執
行 處 的 工 作 , 進 行 了 有 效 的 監 察 ; 我 亦 很
高 興 見 到 執 行 處 以 合 理 和 具 問 責 性 的 態 度
履 行 職 務 。

Another area of concern relates to cross
jurisdiction investigation. ORC members are
increasingly aware of the difficulties encountered
by ICAC in gathering evidence outside Hong Kong
for presentation in court. The time-consuming
process involved in obtaining evidence from
another jurisdiction always poses a challenge in
the course of investigation.
In spite of the various challenges faced by
ICAC, the Committee observed that the conviction
rate in 2006 was maintained at a high level of
84% and 88% in terms of persons and cases
respectively. The Committee also noted the effort
of ICAC in enhancing the investigative capability
of its staff through well-rounded training and
experience sharing with other law enforcement
agencies and regulatory bodies.
ELECTIONS
In 2006, the Commission received 57
election complaints. Among them, six pertained to
the 2006 Election Committee Sub-sector Election,
one concerned the 2004 Legislative Council
Election, 17 the District Council By-elections, 27
the Village Representative Election and Village
Representative (VR) By-elections, and six related
to the 2003 and 2007 Rural Committee (RC)
Elections. There were 14 complaints alleging
bribery and the remainder alleged breaches
under the Elections (Corrupt and Illegal Conduct)
Ordinance such as providing refreshment and
entertainment at elections, or publishing false or
misleading information about a candidate. The
importance of clean elections, however, cannot be
over-emphasised.
The Committee noted that elections
held during the past few years were generally
conducted in an orderly manner and remained
largely clean. The Committee has, however, raised
concern about inadequate legislative control
over rural elections. The Committee has urged
the Administration to consider including VRs
and RCs as "public servants" and "public bodies"
respectively under the POBO, and to place future
RC Election under legislative control. An interdepartmental
working group under the Home
Affairs Bureau is now reviewing the matter.
