運 輸 署 - 打 擊 非 專 利 巴 士 的 執 法 行 動
運 輸 署 長 按 《 道 路 交 通 條 例 》 發
出 客 運 營 業 證 , 規 管 所 有 非 專 利 巴 士 的
營 運 。 現 時 本 港 共 有 八 類 公 共 非 專 利 巴
士 服 務 , 如 邨 巴 和 旅 遊 車 等 , 客 運 營
業 證 持 有 人 不 論 經 營 何 種 服 務 , 均 須 先
獲 得 運 輸 署 長 的 批 准 。 然 而 , 有 些 非 專
利 巴 士 經 營 者 卻 進 行 非 法 經 營 , 也 有 經
營 者 的 業 務 範 圍 超 出 其 客 運 營 業 證 的 規
定 。 根 據 《 道 路 交 通 條 例 》, 如 運 輸 署
長 經 調 查 及 研 訊 後 , 發 現 客 運 營 業 證 持
有 人 違 反 經 營 條 款 , 便 可 取 消 或 暫 時 吊
銷 該 客 運 營 業 證 , 或 更 改 該 證 的 條 款 。
倘 若 持 證 人 不 接 納 運 輸 署 長 的 決 定 , 可
向 交 通 審 裁 處 申 請 覆 核 , 更 可 就 審 裁 處
的 決 定 申 請 司 法 覆 核 。
研 究 指 出 , 違 規 客 運 營 業 證 持 有
人 可 能 會 不 惜 使 用 貪 污 手 段 以 儘 量 拖 延
研 訊 程 序 , 以 及 要 求 運 輸 署 人 員 採 取 對
他 有 利 的 行 動 。 研 究 又 指 出 , 由 於 資
源 及 程 序 所 限 , 調 查 及 研 訊 過 程 需 時 甚
久 , 在 此 期 間 , 客 運 營 業 證 持 有 人 可 繼
續 非 法 經 營 。 因 此 , 防 貪 處 建 議 運 輸 署
應 加 快 處 理 程 序 , 如 對 個 別 行 動 階 段 設
定 內 部 時 限 , 並 成 立 更 多 交 通 審 裁 處 ,
以 縮 短 等 候 覆 核 個 案 的 時 間 。
stamping a visitor's travel document, creating
an EXPRESS clearance record, and the traveller
physically passing through the control counter,
are not technically linked up. An unscrupulous
Immigration Officer may therefore be able to
create a false clearance record without the
subject actually crossing a control point, or allow
a traveller to pass without making a record. We
therefore recommended that ImmD should explore
new modes of clearance operation to ensure
that these processes take place in tandem. To
diffuse any pre-arranged corrupt dealings for a
compromised officer to handle a particular visitor's
clearance, we recommended that ImmD should
use the serpentine queuing arrangement, that is,
one queue for a number of counters instead of
allowing visitors to select any particular clearance
counters, for all visitors in all control points.

Enforcement
Lease enforcement work is undertaken
by the District Lands Offices (DLOs) of LandsD.
Breaches of lease conditions are mainly detected
through public complaints, referrals from other
government departments, and sometimes through
the DLOs' own routine patrols. Problems with
lease enforcement in the urban area involve the
misuse of industrial buildings for commercial use,
and in the rural areas, the erection of unauthorised
building works (UBW) in village houses.
Due to resource constraints, LandsD
accords relatively low priority to lease enforcement
work and carries out enforcement action in a
selective manner, resulting in a large backlog of
cases at the DLOs. We recommended that LandsD
should critically review its enforcement strategy
with a view to enhancing effectiveness, such as by
outsourcing the more routine enforcement work to
private contractors. We further recommended that
LandsD should expedite the implementation of a
rationalisation scheme to regularise minor UBW.

The NFB service is regulated through the
Passenger Service Licences (PSL) issued by the
Commissioner for Transport under the Road Traffic
