以 至 董 事 的 貪 污 詐 騙 案 件 。 由 於 香 港 是
一 個 國 際 金 融 中 心 , 公 眾 對 它 的 市 場 是
否 廉 潔 的 觀 感 , 會 直 接 影 響 投 資 者 的 信
心 以 至 香 港 整 體 經 濟 的 利 益 。 委 員 會 促
請 商 界 全 力 提 升 企 業 誠 信 和 管 治 , 以 鞏
固 本 地 和 海 外 投 資 者 對 香 港 的 信 心 。
有 關 跨 地 域 調 查 的 問 題 亦 備 受 關
注 。 委 員 會 察 覺 到 廉 署 在 本 港 以 外 地 域
蒐 集 證 據 作 呈 堂 用 途 時 , 經 常 遇 到 不 少
困 難 。 由 於 涉 及 其 他 司 法 管 轄 區 , 蒐 集
證 據 的 程 序 極 為 耗 時 , 往 往 成 為 調 查 過
程 中 的 一 大 挑 戰 。
儘 管 廉 署 面 對 種 種 挑 戰 , 委 員 會
注 意 到 二 零 零 六 年 的 定 罪 率 仍 維 持 在 一
個 高 水 平 ; 以 人 數 和 案 件 數 目 而 言 , 定
罪 率 分 別 為 84% 和 88%。 此 外 , 委 員 會
很 高 興 見 到 廉 署 繼 續 透 過 全 面 的 培 訓 ,

二 零 零 六 年 , 廉 署 共 接 獲 5 7 宗
與 選 舉 有 關 的 投 訴 , 當 中 六 宗 涉 及 二
零 零 六 年 選 舉 委 員 會 界 別 分 組 選 舉 , 一
宗 涉 及 二 零 零 四 年 立 法 會 選 舉 、17 宗 涉
及 區 議 會 補 選 、27 宗 涉 及 村 代 表 選 舉 及
補 選 , 和 六 宗 涉 及 二 零 零 三 年 及 二 零 零
七 年 鄉 事 委 員 會 選 舉 。 其 中 14 宗 涉 及 賄
選 , 其 餘 則 涉 及 違 反 《 選 舉 ( 舞 弊 及 非
法 行 為 ) 條 例 》, 例 如 在 選 舉 中 向 他 人
提 供 茶 點 或 款 待 , 或 發 布 虛 假 或 有 誤 導
成 分 的 候 選 人 資 料 等 。 維 持 廉 潔 選 舉 ,
實 在 至 為 重 要 。
CORRUPTION IN THE PRIVATE SECTOR
Complaints in respect of the private
sector continues to take up a large portion of
the corruption reports in 2006, totalling 61%
or 2,037, a 9% decrease as compared to 2,247
in 2005. In terms of pursuable reports, there
was a 7% decrease (from 1,868 to 1,731) as
compared to 2005. As in previous years, building
management (BM), and finance and insurance
sectors remained major areas of concern within
the private sector. BM attracted the largest
portion of complaints, amounting to 822 reports
or 40% of the reports received for this sector.
Most of the BM reports were of a minor nature
and were quickly dealt with by the Operations
Department's Quick Response Team. The
Committee noted, however, that there were cases
involving syndicated corruption in the award of
renovation contracts and the operation of Owners'
Corporations, especially those related to the
management of funds and the award of contracts.
Th e f i n a n c e a n d i n s u ra n c e s e c t o r
commands the highest number of persons
prosecuted with a total of 51 persons being
prosecuted for offences under section 9 of POBO
and other related offences, an increase of 82%
compared to 28 in 2005. Noting that efforts are
being made by regulatory authorities to enhance
supervision and to promote corporate governance
in the industry, the Committee urged the finance
and insurance sector to adopt a more proactive
approach to internal governance and risk
management.
One particular concern related to
corruption complaints involving listed companies
and the association of senior staff members
including directors of listed companies in
corruption facilitated fraud. Given Hong Kong's
status as an international financial centre, public
perception of the level of integrity of its market has
a direct impact on the confidence of investors and
the well-being of the economy. The Committee
urges the business community to step up their
efforts in enhancing corporate integrity and
governance in order to safeguard Hong Kong
against possible erosion of confidence of both
local and overseas investors.
