檢 控 及 警 誡
並 非 所 有 犯 罪 者 均 會 被 檢 控 。 根
據 律 政 司 發 出 的 指 引 , 假 如 罪 行 性 質
輕 微 , 特 別 是 檢 控 並 不 符 合 公 眾 利 益 ,
便 可 對 當 事 人 施 行 警 誡 。 二 零 零 六 年 年
內 , 共 有 341 人 被 廉 署 檢 控 ,45 人 被 施
行 警 誡 。 自 一 九 七 四 年 以 來 被 廉 署 檢 控
或 警 誡 的 人 數 詳 見 附 錄 九 。
在 被 檢 控 的 人 士 當 中 , 有 24 名 是
政 府 人 員 ,10 名 是 公 共 機 構 僱 員 ,245
名 來 自 私 營 機 構 ,62 名 則 為 個 別 市 民 ,
他 們 與 政 府 或 公 職 人 員 進 行 事 務 往 來 時
涉 嫌 行 賄 而 被 控 觸 犯 《 防 止 賄 賂 條 例 》
或 《 廉 政 公 署 條 例 》。 附 錄 十 詳 列 在 二
零 零 六 年 因 貪 污 及 相 關 罪 行 而 被 檢 控 的
政 府 部 門 、 公 共 機 構 及 私 營 機 構 人 員 數

被 廉 署 檢 控 的 私 營 機 構 人 員 及 個
別 市 民 合 共 307 人 , 其 中 102 人 因 涉 及
《 防 止 賄 賂 條 例 》 第 9 條 所 指 的 貪 污 交
易 而 被 檢 控 , 九 人 因 行 賄 政 府 或 公 職
人 員 而 被 控 觸 犯 上 述 條 例 第 4(1) 條 或 第
8 條 , 一 人 被 控 協 助 及 教 唆 他 人 觸 犯 第
3 條 , 兩 人 被 控 不 遵 從 根 據 第 14 條 發 出
的 通 知 書 的 規 定 , 一 人 被 控 作 出 虛 假 舉
報 , 一 人 被 控 披 露 受 廉 署 調 查 人 士 的 身
分 , 其 餘 191 人 則 因 為 觸 犯 《 廉 政 公 署
條 例 》 所 訂 罪 行 而 被 檢 控 。

廉 署 在 年 內 將 640 宗 非 貪 污 性 質
的 投 訴 , 轉 交 有 關 的 政 府 部 門 及 公 共 機

2005. During the year, 2,584 investigations were
completed. Detailed breakdowns are shown in the
preceding table and Appendix 5. At year-end, 72
cases were awaiting legal advice.
Prosecutions and Cautions
Not all offenders are prosecuted. The
guidelines issued by the Department of Justice
provide that a caution may be administered for
minor offences, particularly when it is considered
that it is not in the public interest to prosecute.
In 2006, 341 persons were prosecuted and 45
formally cautioned. A breakdown of the number
of persons prosecuted and cautioned since 1974 is
shown at Appendix 9.
Of those prosecuted, 24 persons were
government servants, 10 were employees of public
bodies, 245 were from the private sector and 62
were individuals who were involved in corruption
during the course of their dealings with government
or public servants contrary to the Prevention
of Bribery Ordinance or the ICAC Ordinance.
Appendix 10 shows the number of persons from
various government departments, public bodies
and the private sector who were prosecuted in
2006 for corruption and related offences.
Among the 307 prosecutions involving
private individuals, 102 persons were charged
with corrupt transactions in the private sector
contrary to section 9 of the Prevention of Bribery
Ordinance, nine persons were charged with
offering bribes to government or public servants
contrary to section 4(1) or section 8 of the
Ordinance, one person with aiding and abetting to
commit section 3 of the Ordinance, two persons
for failing to comply with section 14 notices,
one person with making a false report, one for
disclosing the identity of persons under ICAC
investigation, and 191 persons were prosecuted for
offences which were investigated under the ICAC
Ordinance.
Appendix 11 shows the types of corruption
and related offences prosecuted in 2006. A
breakdown of persons prosecuted for offences
connected with or facilitated by corruption
offences is at Appendix 12.
