緒 言

Introduction
《 廉 政 公 署 條 例 》 ( 香 港 法 例
第 204 章 ) 於 一 九 七 四 年 二 月 十 五 日 生
效 , 廉 政 公 署 亦 於 同 日 正 式 成 立 。
在 此 以 前 , 偵 查 貪 污 的 工 作 是 由
香 港 警 務 處 轄 下 之 反 貪 污 部 負 責 。 及 至
一 個 調 查 委 員 會 就 香 港 的 貪 污 及 其 他 相
關 問 題 發 表 調 查 報 告 後 , 當 時 的 總 督 決
定 成 立 一 個 獨 立 機 構 打 擊 貪 污 。
體 制
廉 政 公 署 依 據 《 廉 政 公 署 條 例 》
成 立 並 獲 得 所 賦 權 力 。 由 於 廉 政 專 員 直
接 向 行 政 長 官 負 責 , 廉 政 公 署 具 有 其 獨
立 性 。 就 政 府 體 制 而 言 , 廉 政 公 署 在 執
行 職 務 上 乃 一 獨 立 機 構 。
組 織
廉 署 的 組 織 包 括 廉 政 專 員 辦 公 室
及 三 個 專 責 部 門 , 即 執 行 處 、 防 止 貪 污
處 及 社 區 關 係 處 , 署 內 的 行 政 工 作 則 由
行 政 總 部 負 責 。 廉 署 的 組 織 詳 見 附 錄 一
圖 表 。
諮 詢 委 員 會
行 政 長 官 委 任 各 界 賢 達 , 組 成 獨
立 的 諮 詢 委 員 會 , 專 責 審 查 廉 政 公 署 的
工 作 。「 貪 污 問 題 諮 詢 委 員 會 」、「 審
查 貪 污 舉 報 諮 詢 委 員 會 」、「 防 止 貪 污
諮 詢 委 員 會 」、 以 及 「 社 區 關 係 市 民 諮
詢 委 員 會 」 的 工 作 報 告 詳 載 於 另 一 刊

廉 政 專 員 的 職 責
廉 政 專 員 須 就 《 廉 政 公 署 條 例 》
第 12 條 所 列 職 責 , 直 接 向 行 政 長 官 負
責 。 廉 政 專 員 的 職 責 是 :
The Independent Commission Against
Corruption (ICAC) was established on 15 February
1974 with the enactment of the Independent
Commission Against Corruption Ordinance (Cap.
204).
B e f o r e t h e n , t h e d e t e c t i o n a n d
investigation of corruption was the responsibility
of the Anti-Corruption Office of the Hong
Kong Police Force. The decision to set up an
independent organisation to tackle corruption
was made by the then Governor following a
Commission of Inquiry into the problem of
corruption in Hong Kong and other related
matters.
CONSTITUTION
The ICAC derives its charter from the
Independent Commission Against Corruption
Ordinance. Its independence is established by
the Commissioner being formally and directly
responsible to the Chief Executive. In carrying out
its work, the ICAC functions as an independent
organ of the public service.
ORGANISATION
The ICAC comprises the office of the
Commissioner and three functional departments
- O perations, Corruption Prevention and
C o m m u nit y Relations - s e r vice d by t h e
Administration Branch. Its organisation is shown
in the chart at Appendix 1.
ADVISORY COMMITTEES
The work of the ICAC comes under the
scrutiny of independent committees comprising
responsible citizens drawn from all sectors of the
community and appointed by the Chief Executive.
Reports on the work of the Advisory Committee
on Corruption, the Operations Review Committee,
the Corruption Prevention Advisory Committee
and the Citizens Advisor y Commit tee on
Community Relations are contained in a separate
publication. Membership lists of the four advisory
committees are at Appendix 2.
