一 個 由 三 位 審 查 貪 污 舉 報 諮 詢
委 員 會 非 官 方 成 員 輪 流 組 成 的 小 組 委 員
會 , 年 內 共 舉 行 了 八 次 會 議 , 就 2,576 宗
性 質 較 輕 微 的 案 件 及 678 宗 無 法 追 查 的 貪
污 舉 報 , 進 行 審 議 及 提 供 意 見 。 小 組 委
員 會 隨 後 將 審 議 結 果 向 主 會 報 告 , 並 得
到 主 會 確 認 。
過 去 兩 年 , 公 眾 對 執 法 機 關 進
行 秘 密 監 察 的 調 查 方 法 作 出 了 討 論 及 爭
議 。 由 於 貪 污 罪 行 有 著 高 度 隱 蔽 及 串 謀
犯 案 的 特 性 , 故 此 使 用 秘 密 監 察 的 調 查
方 法 , 是 廉 署 一 向 用 來 打 擊 貪 污 罪 行 的
有 效 對 策 。 為 確 保 能 在 有 效 執 法 和 保 障
個 人 私 隱 間 取 得 平 衡 , 委 員 會 於 二 零 零
五 年 促 請 政 府 盡 早 立 法 , 為 執 法 機 關 進
行 秘 密 調 查 工 作 提 供 穩 妥 的 法 律 依 據 。
《 截 取 通 訊 及 監 察 條 例 》 於 二 零 零 六 年
八 月 通 過 成 為 法 例 , 為 執 法 機 關 進 行 秘
密 監 察 的 調 查 工 作 提 供 了 清 晰 的 法 律 基
礎 和 明 確 的 行 動 指 引 。 委 員 會 對 此 深 表
歡 迎 , 亦 會 密 切 關 注 新 法 例 對 廉 署 打 擊
貪 污 的 影 響 。
整 體 貪 污 情 況
廉 署 在 二 零 零 六 年 共 接 獲 3,339 宗
貪 污 舉 報 , 較 二 零 零 五 年 接 獲 的 3,685 宗
下 跌 9%, 但 較 一 九 九 七 年 接 獲 的 3,057 宗
則 上 升 了 9%。 整 體 而 言 , 貪 污 問 題 仍 受
控 制 。
委 員 會 獲 悉 , 廉 署 在 二 零 零 六 年
接 獲 的 貪 污 舉 報 中 , 具 名 舉 報 佔 73%。 這
數 字 與 二 零 零 五 年 的 數 字 相 同 , 是 廉 署
成 立 以 來 的 最 高 紀 錄 , 充 分 反 映 市 民 對
廉 署 的 肅 貪 工 作 極 具 信 心 。

委 員 會 同 意 政 府 部 門 的 貪 污 問 題
concerning the outcome of investigations, and the
progress of the proposed legislative amendment
on the Common Law Offence of Misconduct in
Public Office (MIPO).
A Sub-Committee comprising three nonofficial
members sitting in rotation was convened
on eight separate occasions to consider and
advise on 2,576 minor investigations and 678
non-pursuable reports of corruption. Findings of
the Sub-Committee were reported to the Main
Committee for endorsement.
There was some public discussion and
debate over the conduct of covert surveillance by
law enforcement agencies in the past two years.
Given the secretive and conspiratorial nature of
corruption, the use of covert surveillance has been
an effective tool in the fight against corruption.
In view of the need to strike a balance between
effective law enforcement and the protection of
personal rights, in 2005, we urged the government
to expedite the introduction of legislation to
provide a firm legal basis for law enforcement
agencies to conduct covert investigations. We are
pleased to note that as a result of the enactment
of the Interception of Communications and
Surveillance Ordinance in August 2006, law
enforcement agencies now have a clear legislative
mandate and recognised operational guidelines
to carry out covert investigations. We will closely
monitor the effect of this new mandate on the fight
against corruption.
GENERAL CORRUPTION SCENE
In 2006, a total of 3,339 corruption reports
were received. This represented a decrease of 9%
compared to 3,685 in 2005 but still represented
an increase of 9% when compared to 3,057
reports in 1997. Overall, corruption appears to be
under control.
The Committee noted that in 2006, 73%
of complainants revealed their identity when
reporting allegations of corruption to the ICAC.
This figure, same as in 2005, is the highest
recorded since the inception of ICAC and is a
strong indicator of public confidence in the anticorruption
efforts of the Commission.
