非 法 工 作 。
審 查 報 告 發 現 , 出 入 境 檢 查 手 續
的 主 要 程 序 , 即 在 旅 客 的 旅 行 證 件 上 蓋
印 、 在 「 快 檢 通 系 統 」 記 錄 有 關 出 入 境
資 料 及 容 許 旅 客 通 過 管 制 櫃 檯 等 , 在 技
術 上 並 非 互 相 連 繫 。 不 法 的 入 境 處 人 員
遂 可 以 在 有 關 人 士 並 沒 有 真 正 過 關 的 情
況 下 製 造 虛 假 出 入 境 記 錄 , 或 容 許 旅 客
過 關 而 不 作 出 相 關 出 入 境 記 錄 。 因 此 ,
防 貪 處 建 議 入 境 處 應 研 究 新 的 出 入 境 檢
查 運 作 模 式 , 確 保 程 序 能 夠 串 連 。 為 使
受 賄 人 員 無 法 進 行 預 先 安 排 的 貪 污 勾
當 , 以 圖 為 某 特 定 旅 客 辦 理 出 入 境 手
續 , 防 貪 處 建 議 入 境 處 於 所 有 管 制 站 採
用 蛇 型 排 隊 方 式 , 安 排 所 有 入 境 的 旅 客
統 一 輪 候 不 同 櫃 檯 , 而 不 讓 他 們 選 擇 個
別 櫃 檯 。

地 政 署 轄 下 各 分 區 地 政 處 負 責 執
行 土 地 契 約 條 款 的 工 作 。 違 反 地 契 條 款
的 個 案 , 大 多 由 市 民 或 其 他 政 府 部 門 轉
介 的 投 訴 、 或 從 分 區 地 政 處 的 日 常 巡 邏
中 揭 發 。 常 見 的 違 規 問 題 , 在 市 區 為 將
工 業 樓 宇 非 法 轉 作 商 業 用 途 , 在 鄉 郊 地
區 則 為 於 小 型 屋 宇 加 建 僭 建 物 。
由 於 資 源 不 足 , 執 行 地 契 條 款 並
不 屬 地 政 署 的 首 要 工 作 , 該 署 只 會 選 擇
性 地 對 個 別 個 案 採 取 行 動 , 因 而 令 分 區
地 政 處 積 壓 了 大 量 未 完 成 的 個 案 。 防 貪
處 建 議 地 政 署 應 仔 細 檢 討 執 行 土 地 契 約
條 款 的 策 略 , 如 將 部 分 較 簡 單 的 執 法 工
作 外 判 予 私 人 承 辦 商 , 以 加 強 成 效 。 此
外 , 防 貪 處 亦 建 議 地 政 署 應 加 快 實 行 小
型 僭 建 物 的 合 法 化 計 劃 。
Housing Department (HD) – Letting and
Management of Public Housing Markets
After divesting its retail premises and
carparks in 2005 through the Link Real Estate
Investment Trust, HD still owns 21 public markets,
three of which are Single Operator Markets
(SOMs), that is, the market is operated by a single
operator who is selected through open tender.
The other 18 traditional markets are managed by
HD or its appointed Property Management Agents
(PMAs). The stalls in these markets are let to
individual tenants through open bidding.
In the letting of SOMs, we recommended
that HD should cease the practice of allowing
proponents to amend, after the close of tenders,
any tender information which may impact on
the tender assessment. We also recommended
that HD should issue guidelines on the tenancy
commencement date and require the responsible
Housing Manager to seek approval from a senior
officer if the date is to be postponed. To tackle the
problem of rampant stall-front obstructions in the
markets, we recommended that HD should require
supervisory officers to conduct surprise checks
and deploy the Mobile Operation Unit of the
Headquarters to conduct independent inspections.
Immigration Department (ImmD) – Lo Wu
Immigration Control Point Procedures
The Lo Wu Immigration Control Point
processes over 200,000 travellers, including Hong
Kong residents, Mainland and foreign visitors
everyday. Clearance of travellers is processed
through ImmD's Entry/Exit Processing and
Records System (EXPRESS) which matches the
characteristics of the travellers against the Doubtful
Visitors Index to help identify doubtful visitors
suspected to attempt to gain entry into Hong Kong
for illicit purposes like illegal employmemt or
prostitution. In early 2006, an Immigration Officer
was convicted of misconduct in public office for
falsifying clearance records for some Mainland
visitors, purporting to show that they had departed
Hong Kong within their permitted limit of stay
and re-entered Hong Kong at a later date, when,
in fact, they had all the while remained in Hong
Kong and taken up employment illegally.
