Limited Warranty StatementEEWarrantyStatementApplera Corporation, through its Applied Biosystems Group(“Applied Biosystems“) warrants to the customer that, for a period ending on theearlier of one year from the completion of installation or fifteen (15) months from thedate of shipment to the customer (the “Warranty Period”), the Applied Biosystems7900HT Fast Real-Time PCR System purchased by the customer (the “Instrument”)will be free from defects in material and workmanship, and will perform inaccordance with the installation specifications set forth in the system specificationssheet which accompanies the instrument or which is otherwise available from anApplied Biosystems sales representative.During the Warranty Period, if the Instrument's hardware becomes damaged orcontaminated or if the Instrument otherwise fails to meet the Specifications,Applied Biosystems will repair or replace the Instrument so that it meets theSpecifications, at Applied Biosystems' expense. However, if the thermal cyclingmodule becomes damaged or contaminated, or if the chemical performance of theInstrument otherwise deteriorates due to solvents and/or reagents other than thosesupplied or expressly recommended by Applied Biosystems, Applied Biosystemswill return the Instrument to Specification at the customer's request and at thecustomer's expense. After this service is performed, coverage of the parts repaired orreplaced will be restored thereafter for the remainder of the original Warranty Period.This Warranty does not extend to any Instrument or part which has been (a) thesubject of an accident, misuse, or neglect, (b) modified or repaired by a party otherthan Applied Biosystems, or (c) used in a manner not in accordance with theinstructions contained in the Instrument User's Manual. This Warranty does notcover the customer-installable accessories or customer-installable consumable partsfor the Instrument that are listed in the Instrument User's Manual. Those items arecovered by their own warranties.Applied Biosystems' obligation under this Warranty is limited to repairs orreplacements that Applied Biosystems deems necessary to correct those failures ofthe Instrument to meet the Specifications of which Applied Biosystems is notifiedprior to expiration of the Warranty Period. All repairs and replacements under thisWarranty will be performed by Applied Biosystems on site at the Customer'slocation at Applied Biosystems's sole expense.No agent, employee, or representative of Applied Biosystems has any authority tobind Applied Biosystems to any affirmation, representation, or warranty concerningthe Instrument that is not contained in Applied Biosystems's printed productliterature or this Warranty Statement. Any such affirmation, representation orwarranty made by any agent, employee, or representative of Applied Biosystems willnot be binding on Applied Biosystems.Applied Biosystems shall not be liable for any incidental, special, or consequentialloss, damage or expense directly or indirectly arising from the purchase or use of theInstrument.
