704.03 The non-retention in employment or the reduction<br />

of assignment below six (6) hours per day on a regular<br />

basis of full-time hourly professional employees (teachers)<br />

resulting from program cancellations or other cutbacks<br />

shall be accomplished on the basis of seniority<br />

among full-time hourly professional employees in the<br />

system within the program and area of certification<br />

affected by the reduction with the following stipulations:<br />

A. Seniority shall be measured from the first day of paid<br />

status in the earliest year of continuous employment<br />

by the <strong>Board</strong> of Education. To qualify as a year of<br />

continuous employment, the employee must have<br />

worked a minimum of 37 weeks with a minimum of<br />

six (6) hours per day on a regular basis during the<br />

year.<br />

B. Such teachers shall be considered in a layoff status<br />

and shall be recalled in the order of seniority as contract<br />

or full-time hourly positions are available for<br />

which they are certified. Such teachers as may be<br />

recalled to contract teaching positions may, at the<br />

option of the <strong>Board</strong>, be reassigned at the end of the<br />

school year to a full-time hourly teaching position.<br />

C. All provisions of Section 704.02 of this article not in<br />

conflict with Section 704.03 shall also apply to fulltime<br />

hourly professional employees.<br />

D. Anyfull-time hourly professional employee whose<br />

assignment is reduced to less than six (6) hours per<br />

day on a regular basis shall be considered on layoff<br />

status; however, such employee may elect to remain<br />

in the less thanfull-time position without prejudicing<br />

hisorher rights under 704.03(B) above. <br />
