112.02<br />

A. Agency fees shall be automatically deductible in<br />

twelve (12) equal installments beginning with the<br />

first pay date after January 15.<br />

B. The prorated balance due shall be deducted from the<br />

final paycheck of a nonmember teacher resigning<br />

his/her position, receiving an unpaid leave of<br />

absence, leaving a bargaining unit position or terminating<br />

his/her employment after the opening of<br />

school.<br />

C. The Association will compensate the <strong>Board</strong> in the<br />

amount of fifteen cents ($.15) per nonmember<br />

deducting teacher per year for the payroll deduction<br />

service to be deducted from the first deduction<br />

period each school year.<br />

D. The <strong>Board</strong> will provide the Association with a single<br />

printout showing the nonmember teachers from<br />

whom such agency fees were deducted. This itemized<br />

statement with a transmittal letter will be prepared<br />

monthly.<br />

112.03 Theforegoing provisions regarding agency fees shall<br />

be subject to all requirements of Ohio Revised Code,<br />

Section 4117.09(C) and all other applicable law of like<br />

subject matter.<br />

112.04 The Association shall indemnify the <strong>Board</strong>, its<br />

members, and its administrative and supervisory employees,<br />

including but not limited to, the Treasurer (all hereinafter,<br />

“the indemnitees”), for, and hold them harmless<br />

from, any and all liability, damages and expenses, including<br />

but not limited to, legal fees at customary rates in the<br />

community and costs, directly or indirectly incurred by<br />

the indemnitees, or any of them, because of any legal<br />

action or administrative claim brought against them as a<br />

result of the provisions of this article. <br />
