istrative or supervisory personnel. “Other administrative or<br />
supervisory personnel” shall include any certificated or professional<br />
employee having the authority to responsibly direct<br />
other certificated or professional employees and the authority<br />
to hire,transfer, assign, promote, discharge or discipline<br />
other certificated or professional employees, or to responsibly<br />
recommend such action. If the <strong>Board</strong> of Education reassigns<br />
or removes the work of student safety specialists from<br />
the bargaining unit, the <strong>Board</strong> of Education shall have the<br />
obligation to bargain with the Association about the<br />
effect(s) of the <strong>Board</strong>’s decision.<br />
Article 102<br />
Responsibility of the <strong>Board</strong><br />
It is recognized by the parties that the <strong>Board</strong> is invested by<br />
the laws of the <strong>State</strong>ofOhiowiththemanagementandcontrol<br />
of all the public schools in the Columbus City School<br />
District. The authority shall include, but shall not be limited<br />
to,the right to hire, discharge or discipline teachers, subject<br />
to the terms of this <strong>Agreement</strong> and applicable law, and<br />
the authority to make such rules and regulations, subject to<br />
the terms of this <strong>Agreement</strong> and applicable law, as are necessary<br />
for the government of the public schools, the employees<br />
of the <strong>Board</strong> and the pupils of the schools. Nothing in this<br />
<strong>Agreement</strong> shall constitute a derogation or transfer of the<br />
authority of the <strong>Board</strong> as established by the laws of the <strong>State</strong><br />
of Ohio.<br />
Article 103<br />
Authority of the Superintendent<br />
The administrative authority of the <strong>Board</strong> shall be implemented<br />
by the Superintendent, Deputy Superintendent,<br />
assistant superintendents, principals, assistant principals,<br />
and other administrative or supervisory personnel employed<br />
by the <strong>Board</strong>. The Superintendent shall have the sole<br />
authority to direct, assign andtransfer teachers, subject to<br />
the terms of this <strong>Agreement</strong> and applicable law.<br />
Article 104<br />
Responsibility of the Association<br />
The Association shall represent all teachers of the<br />
Columbus City School District equally and without discrimination,<br />
regardless of their membership or non-membership<br />
in the Association.<br />
Article 105<br />
Equal <strong>Employment</strong> Rights<br />
Members of the bargaining unit will not be discriminated<br />
against in any wayintheexercise of their employment rights<br />
or their rights under this <strong>Agreement</strong> because of race, color,<br />
creed, national origin, age orsex.The<strong>Board</strong>andadministration<br />
will comply with all federal, state and local fair<br />
employment laws.<br />
