shall discuss the matter of ability grouping and make appropriate<br />

recommendations to the principal.<br />

Article 304<br />

Study Halls<br />

304.01 The <strong>Board</strong> shall continue efforts to reduce the number<br />

and size of study halls which have mandatory pupil<br />

attendance.<br />

304.02 In academic assist programs in middle schools, the<br />

number of pupils under the supervision of a teacher shall<br />

not exceed the maximum class size for a middle school<br />

academic class. Such supervision by a teacher shall count<br />

as an assigned duty.<br />

Article 305<br />

Special Education<br />

305.01 Ateacher who objects to the decision of an<br />

Individualized Educational Program (IEP) team may<br />

appeal such decision to the appropriate special education<br />

supervisor by submitting the objection, in writing, on a<br />

mutually agreed upon form, to the building principal for<br />

transmittal to such supervisor within three (3) school<br />

days. The written objection shall include the specific reasons<br />

which formed the basis for the objection. In such an<br />

event, the special education supervisor will conduct a<br />

conference with the teacher in a reasonably timely manner<br />

but not to exceed fifteen (15) school days, unless<br />

extended by mutual agreement, after receipt of the objection.<br />

If the teacher is not satisfied with the disposition of<br />

the conference, the principal will, within three (3) school<br />

days after the conference, submit the objection to the<br />

Director of Special Education. In such an event, the<br />

Director of Special Education will conduct a conference<br />

with the teacher in a reasonably timely manner but not<br />

to exceed fifteen (15) school days, unless extended by<br />

mutual agreement after receipt of the objection. The<br />

director shall make a final determination with regard to<br />

theobjection and shall communicate such decision, in<br />

writing, to the teacher in a reasonably timely manner but<br />

not to exceed ten (10) school days after the conference.<br />

In the event the Director of Special Education determines<br />

that the volume of appeals makes it impractical for<br />

the director to conduct all such conferences, the director<br />

mayutilize a designee other than the special education<br />

supervisor involved in thepreviousconference.<br />

305.02 Teachers at Alum Crest, Clearbrook and Beatty<br />

Park schools will continue to be assigned the services of<br />

school instructional assistants at present assignment levels<br />

through the term of this <strong>Agreement</strong>.<br />

305.03 TheAssociation Building Councils at Alum Crest,<br />

Clearbrook and Beatty Park schools schools shall devel-<br />
