4. If a final selection of a candidate to fill the vacancy<br />
in question has been made, the conciliator has no<br />
authority to change or overturn the selection.<br />
211.02 Involuntary Transfers<br />
Transfers will be on a voluntary basis, whenever possible.<br />
However, correct and proper operation of the school district<br />
will necessarily require that involuntary transfers be<br />
made. In making involuntary transfers, the convenience<br />
and wishes of the individual teacher will be honored to<br />
theextentthatthese considerations do not conflict with<br />
the instructional requirements and best interests of the<br />
school district and the pupils. If the teacher so elects,<br />
involuntary transfers will only be made after a conference<br />
between the teacher, principal and Executive<br />
Director of Human Resources, or his/her designated<br />
representative from the Human Resources Department,<br />
concerning the basis for this transfer. The teacher<br />
involved may be accompanied by an Association representative<br />
of his/her choice at such conference. After the<br />
date the above conference has been made available by<br />
theHuman Resources Department, teachers shall be<br />
givenaminimumoftwo (2) school days’ notice before<br />
receiving students in their new assignment if the transfer<br />
is to be carried out. Teachers transferred involuntarily<br />
during the school year, after students have initially<br />
reported, shall be provided two (2) school days without<br />
pupils to work in the school they are leaving and to work<br />
in their newly-assigned school in preparation for their<br />
new teaching duties. At least one of the two such days<br />
shall be in the newly-assigned school.<br />
211.03 Staff Reductions<br />
A. Staff reduction transfers which occur because of<br />
declining enrollment or because of other personnel<br />
reductions at a given school or in a given program<br />
shall be based on seniority as provided herein.<br />
Seniority shall be measured from thefirst day of paid<br />
status resulting from the most recent employment by<br />
the <strong>Board</strong> as a member of the Association bargaining<br />
unit. Incaseofatie,thedateof<strong>Board</strong>action to<br />
employ shall determine seniority. Except as provided<br />
elsewhere, the staff member(s) to be transferred shall<br />
be the least senior teacher(s) within the given elementary<br />
school’s grade level category to be reduced<br />
or within the given middle or high school’s teaching<br />
area to be reduced.<br />
B. Grade level categories in an elementary school shall<br />
be kindergarten and grades 1 through 5. Identification<br />
of staff reduction teachers shall be based upon<br />
grade level assignment prior to reorganization for the<br />
