Memorandum of <strong>Agreement</strong><br />

SuccessWorks Academy<br />

Whereas, the Columbus <strong>Board</strong> of Education (hereafter<br />

referred to as the “<strong>Board</strong>”) andtheColumbusEducation<br />

Association (hereafter referred to as “CEA”) have discussed<br />

the matter concerning the impact of the <strong>Board</strong> and CEA<br />

<strong>Agreement</strong> Article 211 and its effects to SuccessWorks<br />

Academy (SWA).<br />

Whereas, the <strong>Board</strong> and the CEA are parties to a collective<br />

bargaining agreement, which provisions require Article 211<br />

compliance;<br />

It is hereby agreed to as follows:<br />

The <strong>Board</strong> and CEA shall agree to “waive” the <strong>Board</strong> and<br />

CEA collective bargaining agreement Article 211 requirements<br />

for SuccessWorks Academy. Both parties agree to be<br />

bound by the terms of this Memorandum of <strong>Agreement</strong><br />

(MOA). This MOA shall include, but not be limited to, the<br />

following:<br />

1.The Article 211 interview and placement process<br />

requirements for SWA shall be waived.<br />

2.The Article 211 job fair process requirements will not<br />

be in effect.<br />

3.Any vacancy that remains unfilled after regular interviews<br />

of existing teachers shall be filled with new hires<br />

provided a lay-off situation is not created by this<br />

action.<br />

4.The <strong>Board</strong> retains its right to administer involuntary<br />

transfers.<br />

Nothing hereinshallpreclude the <strong>Board</strong> and CEA from<br />

entering into lawful agreements modifying the terms of the<br />

Memorandum of <strong>Agreement</strong>; however, neither party shall<br />

be obligated to agree tosuchmodifications. This agreement<br />

shall remian in effect until one party submits to the other<br />

party a dated request to terminate this MOA.<br />
