City School District <strong>Board</strong> of Education (“CBE”) and the<br />

Columbus Education Association (“CEA”).<br />

In accordance with Internal Revenue Service regulations<br />

and federal law effective January 1, 2009, CBE is adopting a<br />

403(b) Plan to enable CEA members to invest a portion of<br />

their annualincomeintotax-deferred retirement benefit<br />

plans. CEA and CBE unerstand and agree that components<br />

of the Plan are mandated by Internal Revenue Service regulations<br />

and federal tax law. To the extent that Internal<br />

Revenue Service regulationsandfederal tax law do not<br />

impose mandates requiring the adoption, content, administration<br />

and operation of the 403(b) Plan, CEA and CBE<br />

recognize and agree that they are obligated to bargain the<br />

403(b) Plan to the full extent required by R.C. Chapter<br />

4117 and their collective bargaining agreements.<br />

Agreed to by CEA and CBE on the date above written.<br />

This MOU shall remain in effect until mutually cancelled in<br />

writing by CEA and CBE.<br />

Memorandum of <strong>Agreement</strong><br />

Eight-Period Day in High Schools and Middle Schools<br />

The Columbus <strong>Board</strong> of Education and the Columbus<br />

Education Association (CEA), which are parties to a collective<br />

bargaining agreement, agree to this Memorandum as an<br />

addition to terms set forth in the collective bargaining<br />

agreement:<br />

1. Beginning with the school year (SY) 2009–<br />

2010, all high schools (HS) and middle schools<br />

(MS) in the Columbus City Schools District,<br />

with the exception of Fort Hayes Arts and<br />

Academic High School, Eastmoor Academy,<br />

and Columbus Alternative High School, shall<br />

institute a student day consisting of eight (8)<br />

52–55 minute periods. No teacher shall be<br />

assigned more than five (5) periods of instruction<br />

per day. HS English teachers will have two<br />

(2) conference periods. In the event any school<br />

or teacher elects to deviate from this schedule,<br />

the school must first obtain approval from the<br />

Reform Panel.<br />

2. The HS/MS teacher workday, with the exception<br />

of the aforementioned schools cited in section<br />

one, shall be from 7:15 a.m. to 2:45 p.m.,<br />

with a 7:30 a.m. to 2:30 p.m. student day. No<br />

teacher will have more than a seven and one-<br />
