set forth in 1201.07; however, the last negotiation meeting<br />

shall be held not later than fifteen (15) days after the<br />

first meeting. In the event the members of the Joint<br />

Negotiation Committee are unable to reach agreement<br />

during the period of interim negotiations, all unresolved<br />

issues will be submitted to final and binding arbitration.<br />

1502.03 At the last negotiations meeting, the Joint<br />

Negotiation Committee will request the American<br />

Arbitration Association to submit to themalistofqualified<br />

arbitrators. The American Arbitration Association<br />

shall be instructed to submit the list within ten (10) days<br />

of the date of request. Within three (3) days of the<br />

receipt of suchalist, the <strong>Board</strong> and the Exclusive<br />

Representative shall select the arbitrator by alternately<br />

striking names from the list submitted. The arbitration<br />

shall be held in accordance with the rules of the<br />

American Arbitration Association.<br />

1502.04 There shall be no interim negotiations during the<br />

term of this <strong>Agreement</strong> except as provided in Section<br />

1502.01 of this Article. In the event additional funds<br />

from the state require mandated raises for members of<br />

the bargaining unit, the salaryincreases herein provided<br />

shall be considered to be a result of such mandated raises<br />

and any such stipulated raises that require the <strong>Board</strong> to<br />

exceed the salary levels provided herein in any given year<br />

shall not result in increasing the salary levels provided in<br />

thesucceeding year(s).<br />

Article 1503<br />

Reform Panel<br />

1503.01 TheReform Panel shall facilitate the implementation<br />

of (a) initiatives directed at the improvement of<br />

teaching and learning conditions in the District, (b)<br />

requests for variances that may be submitted by schoolbased<br />

shared decision-making cabinets, and (c) instructional<br />

and curricular recommendations that may be<br />

made by committees created by the panel. The panel<br />

shall operate as a joint committee as provided in Article<br />

506 of this <strong>Agreement</strong>.<br />

1503.02 The panel shall have the authority to grant and<br />

cancel variances to this <strong>Agreement</strong> and shall have the<br />

authority to require variances in practice in one or more<br />

schools. The panel may grant variances for a specific<br />

period of time; if not, the variances shall continue until<br />

changed. School-based shared decision-making cabinets<br />

mayapply for renewal of variances which are scheduled<br />

to expire. Approvalbythepanelshallrequireamajority<br />

vote of the panel membership. Such approval shall not<br />

be unreasonably denied. Variances from this <strong>Agreement</strong><br />

shall also require the approval of the Superintendent and<br />

Association President.<br />
