AGREEMENT<br />

between the<br />

COLUMBUS BOARD OF EDUCATION<br />

and the<br />

COLUMBUS EDUCATION ASSOCIATION<br />

This <strong>Agreement</strong> entered into at Columbus, Ohio, this sixteenth<br />

day of June 2009, between the Columbus <strong>Board</strong> of<br />

Education of the Columbus City School District (hereinafter<br />

referred to as the “<strong>Board</strong>”) and the Columbus<br />

Education Association (hereinafter referred to as the<br />

“Association or CEA”).<br />

Recognition<br />

The<strong>Board</strong> recognizes the Association as the sole and exclusive<br />

bargaining representative for all teachers of the District.<br />

Forpurposes of this <strong>Agreement</strong>, the term “teachers” shall<br />

mean the certificated teaching employees of the Columbus<br />

City School District including, but not limited to, certificated/licensed<br />

teachers, nurses, occupational therapists,<br />

physical therapists, dental hygienists, full-time (minimum of<br />

six [6] hours per day and a minimum of thirty-seven [37]<br />

weeks per year) hourly-rated teachers, part-time employee<br />

positions that are scheduled for more than twelve (12)<br />

hours each week during the school year and require licensure<br />

from the Ohio Department of Education (“part-time<br />

teachers”), part-time hourly-rated tutors who work regularly<br />

during the majority of the school year, latchkey teachers and<br />

instructional support substitutes. “Teachers” shall also mean<br />

other regular full-time professional staff members except<br />

classified and civil-service type personnel and except instructional<br />

assistants and educational media aides. Members of<br />

the bargaining unit as defined abovemayhereinafter be<br />

referred to as “teachers” or “members of the bargaining<br />

unit.” However, only those provisions of this <strong>Agreement</strong><br />

which are specifically identified as applicable to hourly-rated<br />

tutors, latchkey teachers, instructional support substitutes<br />

and part-time teachers shall apply to such employees. The<br />

bargaining unit shall include a person hired as a regular contract<br />

teacher who (a) fails to pass the appropriate PRAXIS<br />

test(s) within the first sixty (60) work days and (b) serves in<br />

the sameassignment for more than forty-five (45) days so<br />

long as the person is continued in that same assignment. All<br />

employees herein defined as teachers shall be members of<br />

the bargaining unit, butsaidbargainingunitshallexclude<br />

the Superintendent, Deputy Superintendent, assistant superintendents,<br />

principals, assistant principals, and other admin-<br />
