Chapter 1100<br />

Article 1101<br />

Applicability<br />

This Chapter shall govern “latchkey teachers” who work<br />

regularly during the majority of the school year. The parties<br />

acknowledge that the <strong>Board</strong> of Education may create or<br />

change the supervisory authority over the latchkey program<br />

and latchkey teachers.<br />

Article 1102<br />

Latchkey Contracts<br />

Latchkey teachers shall be offered appropriately worded<br />

individual one (1)-year latchkey contracts. The regular distribution<br />

of latchkey contracts shall be on or before June 15.<br />

All latchkey teacher contracts shall be deemed automatically<br />

nonrenewed as of their expiration date and no action or<br />

notification by the <strong>Board</strong> shall be required in connection<br />

with such nonrenewal. The Superintendent or designee shall<br />

determine the number of latchkey teachers needed. All<br />

latchkey contracts shall have language mutually agreed to by<br />

the <strong>Board</strong> and the Association.<br />

Article 1103<br />

Assault Leave<br />

In addition, a latchkey teacher may use up to twenty (20)<br />

days of assault leave due to injury resulting from a physical<br />

assault on a latchkey teacher which occurs on <strong>Board</strong> premises<br />

or which occurs off <strong>Board</strong> premises in connection with<br />

the performance of assigned duties, subject to the following<br />

stipulations:<br />

A. The latchkey teacher’s conduct was within the<br />

bounds of general standards of professional behavior;<br />

B. The building administrator or other appropriate<br />

administrator was notified as soon as possible of the<br />

occurrence;<br />

C. The latchkey teacher submits the certificate required<br />

in case of sick leave absence, accompanied by the<br />

physician’s statement required below;<br />

D. The latchkeyteacher provides a physician’s statement<br />

describing the nature and duration of the resulting<br />

disability andthenecessity of absence from regular<br />

employment, with the findings of the physician subject<br />

to review by the <strong>Board</strong> physician;<br />

E. In the event the foregoing conditions are satisfied,<br />

none of the first twenty (20) days of absence resulting<br />

from such occurrence shall be deducted from the<br />

latchkey teacher’s accumulated sick leave;<br />

F. Workers’ Compensation cannot be received simultaneously<br />

with sick leave benefits.<br />
