line specified shall be extended through the period of<br />

open enrollment during the one-time offering of the<br />

Limited Separation Plan (LSP) noted in Article 811. For<br />

those choosing to enroll in the LSP, the severance benefits<br />

described shall be combined with the separation<br />

incentive and paid out as described in the LSP Plan<br />

Document, a cash payout is not an option.<br />

Article 811<br />

Limited Separation Plan (LSP)<br />

811.01 The ColumbusCitySchools <strong>Board</strong> of Education is<br />

offering a Limited Separation Plan to staff in order to<br />

address budgetary and operational needs going into<br />

Fiscal Year 2007. Eligibility, timing requirements, and<br />

plan design benefits are contained in the LSP Plan<br />

Document as approved by the <strong>Board</strong> of Education,<br />

except as modified in Article 811.02-811.08. The <strong>Board</strong>'s<br />

adoption and offering of the LSP is not an on-going contractual<br />

obligation.<br />

811.02 Those completing forms by April 12, 2006, will<br />

have untilApril 19, 2006, to rescind their contracts in<br />

accordance with the Plan Document, afterwhich time<br />

their enrollment becomes binding, irrevocable and<br />

enforceable by the <strong>Board</strong> of Education.<br />

811.03 Individual teachers who enroll in the LSP enter into<br />

an agreement with the <strong>Board</strong> of Education to have their<br />

separation performed in accordance with the terms specified<br />

in the individual contract and as specified in the<br />

LSP Plan Document.<br />

811.04 All teachers who enroll in the LSP agree to an irrevocable<br />

resignation effective on or before June 30, 2006,<br />

unless the district informs the teacher before May 31,<br />

2006, of its intent to exercise the operational needs provision<br />

in the LSP extending the teacher's commitment<br />

for up to one year, while remaining eligible for the full<br />

benefits of the LSP in accordance with the Plan<br />

Document.<br />

811.05 The District further intends not to rehire any teacher<br />

who resigns under the LSP except as may be required<br />

within areas of critical shortage and jointly agreed to by<br />

the Superintendent andtheAssociation.<br />

811.06 For those employees who provide evidence of 29 or<br />

34 years of documented and funded service with STRS<br />

as of June 30, 2006, the district shall make available the<br />

opportunity for that employee to reach 30 or 35 years<br />

respectively and still be eligible for the full LSP benefit,<br />

provided the employee announces their effective retirement<br />

date during the open enrollment period.<br />

811.07 In teaching areas where the number of participants<br />

exceed the number identified to be released by June 30,<br />

2006, the most senior employees will have preference with<br />
