mately mid-morning or mid-afternoon, as determined<br />

by the building principal. Regular or chronic violation of<br />

this provision shall be subject to the grievance procedure,<br />

provided the building principal and Central<br />

Administration have been advised of the claimed violations<br />

and givenareasonable period of time in which to<br />

correct the problem.<br />

302.04 Where unusual scheduling exists, the daily average<br />

of a teacher’s weekly schedule shall approximate the<br />

above time distributions.<br />

302.05 Each elementary staff shall conduct a written ballot<br />

to determine whether there shall be one (1) or two (2)<br />

fifteen (15) minute recesses per day. The results of such<br />

ballot shall be posted on the school’s bulletin board. In<br />

the event of atie,the issue shall be decided by the principal.<br />

That status quo shall remain in effect in future<br />

school years unless the ABC or the principal calls for<br />

reconsideration. Reconsideration can only be called for<br />

once per school year. However, a change in that status<br />

quo can only be implemented after the first two work<br />

days of the regular school year with the principal’s concurrence.<br />

302.06 The parties recognize that a large number of preparations<br />

for high school teachers in the academic areas<br />

maydetract from their teaching effectiveness. Therefore,<br />

high school administrators will make an effort, where<br />

practical with the assigned staff in relation to the school<br />

program, to make teaching assignments to such teachers<br />

inamannerthatwill limit the necessary preparations to<br />

three (3) or fewer for distinctively different courses. The<br />

parties recognize that certain teaching areas, such as<br />

diversified English and foreign language, may tend to<br />

have more exceptions to this goal than other teaching<br />

areas. The parties also recognize that the financial condition<br />

of the school system may negatively impact the<br />

Administration’s effort in this regard.<br />

302.07 Kindergarten through seventh grade classroom<br />

teachers who determine that a student may be retained,<br />

shall develop and submit a Diagnostic Performance<br />

Summary plan to the principal prior to June 1. This<br />

Diagnostic Performance Summary form and procedures<br />

will be mutually developed. The parties shall use the<br />

draft form discussed during bargaining on May 25,<br />

2000, as a guide for content. The form to be used shall<br />

be inacomputerized format (if possible). At the elementary<br />

level, the form shall replace the fourth interim<br />

report for failing students, technology permitting.<br />
