copy of the sanction order to be Treasury Officer for issuance of a cheque to the<br />

registered person.<br />

(2) The duplicate copy of sanction order shall be retained in the Refund Section in<br />

the relevant file.<br />

7. Action to be taken in case of in-admissibility of refund. -- In case there is a<br />

reason to believe that the refund claim is not admissible under the law, the<br />

officer-incharge shall issue a notice to show cause to the concerned registered<br />

person within thirty days of the submission of the tax return in the bank and may<br />

proceed against such person in accordance with the relevant provisions of law.<br />

Provided that the period of thirty days shall not apply where an investigation<br />

into the admissibility of the refund is being carried out under sub-section (4) of<br />

section 10.<br />

Provided further that the taxpayer shall be formally informed about the status of<br />

the refund claim.<br />

8. Action by Treasury Officer. -- (1) On receipt of the sanction order in the office<br />

of the Treasury Officer the relevant particulars of the order, including the name<br />

and address of the registered person, number and date of the sanction order,<br />

amount of refund sanctioned shall be entered in a register by an official<br />

assigned by the Treasury Officer.<br />

(2) The Treasury officer shall issue a cheque for the sanctioned amount of refund in<br />

the name of the registered person and dispatch the cheque to him by registered<br />

post.<br />

9. Refund claim filed by an investor. -- (1) In case the refund claim is filed by an<br />

investor the Auditor or, as the case may be, Deputy Superintendent assigned to<br />

examine the claim shall call for the following documents in order to ascertain<br />

whether the same is admissible under the law:-<br />

(b)<br />

(c)<br />

Bills of entry and tax invoices indicating purchase of plant and machinery.<br />

Allotment order indicating that the plot where the plant and machinery is being<br />

installed has been allotted in the name of the investor and in case the plant and<br />

machinery is being installed on the rented premises a copy of the rent deed may<br />

be furnished.<br />

Copy of feasibility report and budget forecasts.<br />

(2) The investor shall submit an undertaking on a non-judicial stamped paper that<br />

he shall commence production and supply of taxable goods within a period of<br />

two years of the receipt of amount of refund.<br />

(3) The provisions as contained in rule 5 to 8 shall, mutatis mutandis, apply to<br />

refund claim filed by an investor.<br />

(4) If the investor fails to commence production and supply of taxable goods within<br />

a period of two years or such further period as may be allowed by the Collector<br />

of sales tax, action shall be taken against him to recover the amount of sales tax<br />

which as been refunded to him.<br />

10. Refund claim filed by a commercial exporter. -- (1) In case the refund claim is<br />

filed by a commercial exporter, the officer assigned to examine the claim shall<br />

call for the following documents for his examination and ascertainment if the<br />

admissibility of the claim:-
