SUBJECT:-<br />

SOME POINTS RAISED BY FPCC & I REGARDING SALES<br />

TAX<br />

With reference to your un-numbered and unsigned fax massage, the following<br />

comments on the aspects raised in the note are forwarded:-<br />

Value of Supply<br />

When the opinion of Law Division is received, the matter will be reviewed<br />

further in consultation with the FPCC & I if they do not agree with the opinion of the<br />

Law Division.<br />

Special Audit<br />

The Chairman, CBR has discussed this matter with the officials of the Auditor<br />

General‘s Office with a view to resolving this matter. Further progress will be reported in<br />

due course of time. So far as the frequency of audits and the audit of units also subject to<br />

Central Excise is concerned, necessary instructions have been issued.<br />

Limit of Turnover<br />

Previously this limit was Rs. one million only which was enhanced to Rs.2.5<br />

million in budget 1999-2000.<br />

Time Limit for Record Keeping<br />

The requirement to keep sales tax records for five years is the same as provided<br />

in other taxation laws.<br />

Shuttle less Looms<br />

Shuttleless looms, board tapestry looms, air jet looms, water jet looms are all<br />

registered for sales tax purposes. There is no discrimination within this sector. So far as<br />

power looms are; concerned, the sizeable units among them are required to be registered<br />

while the smaller units will not be pressed to get registered for he time being. The levy of<br />

GST on electricity will provide sufficient incentive for even smaller power loom units to<br />

get registered otherwise their competitiveness will be adversely affected.<br />
