PAYMENT OF SALES TAX AND REFUND UNDER SRO 461(I),<br />

DATED 09.04.1999.<br />

I am directed to your letter No.Ref/ST/292/5462, dated 21.04.1999 on the subject<br />

cited above and to say that M/s Yahya Textile Mills Ltd., (Ginning division) contravened<br />

the provisions of the Act for which they have been adequately subjected to the provisions<br />

of the law.<br />

2. As far as M/s Yahya Textile Mills Ltd. are concerned they have received<br />

the purchase invoices in April, 1999 and hence they can claim refund / adjustment under<br />

section 7(2)(I) of the <strong>Sales</strong> <strong>Tax</strong> Act, 1990, provided M/s. Yahya Textiles (Ginning<br />

Divisions) discharge their liability in full and withdraw their petition from the Court.<br />

M/s. Yahya Textile Mills Ltd. (Ginning Division) Notak, Jampur Road, D. G. Khan supplied<br />

ginned cotton to M/s. Yahya Textile Mills Ltd., D.G. Khan during 10/96 to 03/97 without getting<br />

itself registered with <strong>Sales</strong> <strong>Tax</strong> Collectorate under SRO 1271(I)/96, dated 10.11.1996 and<br />

accordingly without issuance of invoices and charging of tax due. The Collectorate made out
