of effective control over historical claims.<br />

109. <strong>The</strong> Republic of <strong>Ch<strong>in</strong>a</strong> (ROC) did station some troops <strong>in</strong><br />

the Paracel <strong>and</strong> Spratly isl<strong>and</strong>s. However, follow<strong>in</strong>g its defeat <strong>in</strong><br />

the Ch<strong>in</strong>ese Civil War, it withdrew the troops. <strong>The</strong> PRC did not<br />

over 1,000 years <strong>in</strong> history. Can <strong>Ch<strong>in</strong>a</strong> claim its historical ties <strong>and</strong><br />

<strong>in</strong>separable connections with Vietnam <strong>and</strong> dem<strong>and</strong> its return to<br />

<strong>Ch<strong>in</strong>a</strong> by say<strong>in</strong>g: “Vietnam historically belongs to <strong>Ch<strong>in</strong>a</strong>; it is an<br />

<strong>in</strong>separable part of <strong>Ch<strong>in</strong>a</strong>” (越南自古以来属于中国;越南是中国<br />

不可分割的领土)? International practice (International Court <strong>and</strong><br />

Arbitration) does not accept congruity as a reason for territorial<br />

claim.<br />
