UNITED NATIONS (UN) CONVENTION ON THE<br />

LAW OF THE SEA (UNCLOS)<br />

SIGNED IN 1982, CAME INTO EFFECT IN 1994 1<br />

Article 19: Mean<strong>in</strong>g of Innocent Passage.<br />

Passage is <strong>in</strong>nocent so long as it is not prejudicial to<br />

the peace, good order or security of the coastal State.<br />

Such passage shall take place <strong>in</strong> conformity with this<br />

Convention <strong>and</strong> with other rules of <strong>in</strong>ternational law.<br />

Passage of a foreign ship shall be considered to be<br />

prejudicial to the peace, good order or security of the<br />

coastal State if <strong>in</strong> the territorial sea (underl<strong>in</strong>e added)<br />

it engages <strong>in</strong> any of the follow<strong>in</strong>g activities:<br />

• any threat or use of force aga<strong>in</strong>st the sovereignty,<br />

territorial <strong>in</strong>tegrity or political <strong>in</strong>dependence<br />

of the coastal State, or <strong>in</strong> any other manner <strong>in</strong><br />

violation of the pr<strong>in</strong>ciples of <strong>in</strong>ternational law<br />

embodied <strong>in</strong> the Charter of the <strong>United</strong> Nations;<br />

• any exercise or practice with weapons of any<br />

k<strong>in</strong>d;<br />

• any act aimed at collect<strong>in</strong>g <strong>in</strong>formation to the<br />

prejudice of the defence or security of the coastal<br />

State;<br />

• any act of propag<strong>and</strong>a aimed at affect<strong>in</strong>g the<br />

defence or security of the coastal State;<br />

• the launch<strong>in</strong>g, l<strong>and</strong><strong>in</strong>g, or tak<strong>in</strong>g on board of<br />

any aircraft;<br />

• the launch<strong>in</strong>g, l<strong>and</strong><strong>in</strong>g, or tak<strong>in</strong>g on board of<br />

any military device;<br />

• the load<strong>in</strong>g or unload<strong>in</strong>g of any commodity,<br />

currency, or person contrary to the customs,<br />
