An example of State/Territory legislative regimes is the Aboriginal Lands Act 1995in Tasmania, which was enacted to return Aboriginal land. By 2006, 55 597hectares of land had been returned under the Act, including the culturally significantsites Wybalenna, Cape Barren Island and Clarke Island. The land is vested in theAboriginal Land Council of Tasmania as freehold land in perpetuity, and cannot bemortgaged.Area of Indigenous owned or controlled landIndigenous owned or controlled land is either held by Indigenous communities orheld by governments on behalf of Indigenous people. Land held by Indigenouscommunities is usually owned by an Indigenous corporation, controlled byIndigenous people. Data on Indigenous landholdings by different forms of tenureare reported in tables 11A.3.1 and 11A.3.2.The area and distribution of Indigenous owned or controlled land in Australia dateback to the decisions of governments in the 1970s and 1980s. In recent years, therate of land grants has slowed.
