If an applicant/participant receives a loan from a friend or family member, how is the income treated? A loan is exempt if there is a written agreement signed and dated by the lender and applicant/participant that clearly specifies: 1. The obligation of the applicant/participant to repay the loan; and 2. A repayment plan that provides for installments of specified amounts that continues on a regular basis until the loan is fully repaid. How is income received from a reverse mortgage treated? A reverse mortgage is considered a loan in the CalWORKs program because there is an obligation to repay the lender. Typically, reverse mortgages are loans borrowed against a home requiring no repayment as long as the owner continues to reside there. The repayment of reverse mortgages is handled differently than conventional loans. To qualify for a reverse mortgage, one must own his/her home, and generally all the owners must be at least 62 years of age. Once the borrower/annuitant dies or otherwise vacates the house, the home is sold and the proceeds are used to repay the lender. For CalWORKs, loans are exempt and are excluded from consideration as income. A home, regardless of it’s value, shall be excluded as property as long as it is occupied by the Assistance Unit. Therefore, reverse mortgage loans are exempt or excluded from income and property consideration. NOTE: This exemption will continue unless the funds are commingled with other funds in an account and are no longer separately identifiable as a loan.
