misdirected, the petition should be cleared and
forwarded to the appropriate District Administrator.
The Administrative Deputy must contact the
CalWORKs Program Section to determine what
further action is to be taken.

How is an overpayment recovered when the
participant is no longer receiving aid?
A demand for repayment notice will be initiated by
the Department for any overpayment amount not
recovered by grant adjustment, or otherwise repaid
when the case is terminated. However, there will be
no attempt to collect on nonfraudulent
overpayments that occurred prior to April 2, 1982 for
reasons other than excess property.
CW 44-352.5 – Referral
to WFP&I
When an overpayment has been discovered, is a
referral to WFP&I required?
When the EW determines that an overpayment
(client/household error) was caused by an
applicant’s/participant’s failure to report information
(including an alleged IPV), a referral to WFP&I must
be made.
A failure to report occurs when the participant has:
Made an oral/written misstatement in response
to an oral/written question from the county/state
concerning his/her income, resources or other
circumstances that may affect the eligibility or
grant amount;
Failed to report changes in income/resources or
other circumstances which may affect the amount of
the grant; and
Failed to report receipt of a grant amount that
he/she knew represented an erroneous
payment.
