Removal (INA Section 243(h), 241(b)(3):
Persons who prove they would be
persecuted if returned to their country. This
status does not lead to permanent
residence.
Documentation
• I-688 section 274.12(a)(10)
• I-766 category “A10”
• Order from immigration judge showing
deportation withheld or cancellation of
removal under section 243(h) or
241(b)(3)
What is the date of entry (DOE)?
The DOE is the date the person is admitted into
the U.S. as a refugee or the date asylum is
granted.
Where should a refugee’s date of entry
(DOE) information be obtained?
It is obtained from the I-94 (which bears a
stamped or handwritten date), letter granting
asylum, immigration order, or passport.
Are verbal reports of the date of entry (DOE)
acceptable?
A DOE that is verbally reported by a refugee is
not acceptable. The I-94, issued to noncitizens
that have been granted admission into the U.S.,
is acceptable as proof which bears the DOE.
The DOE is stamped or handwritten. The I-155,
I-688B and the I-766 are all United States
Citizenship and Immigration Services
documentation which cannot be used to verify a
refugee’s DOE.
When do refugees become eligible for
permanent resident status?
Refugees are usually eligible to adjust their
status to permanent resident within one year of
the date of entry. At this point, the I-551,
Permanent Resident Card, is issued.
What should an Eligibility Worker do when a
refugee becomes a naturalized U.S. Citizen?
