When should an applicant/participant not be
referred to apply for Unemployment Insurance
Benefits (UIB) or Disability Insurance Benefits
(DIB)?
The EW should not refer an applicant/participant to
Employment Development Department (EDD) when
the applicant/participant:
o Has not worked in employment covered by
the Unemployment Insurance Compensation
Law in the last 19 months;
o Is currently receiving UIB/DIB or has a
UIB/DIB claim which is being processed;
o Has exhausted his/her UIB/DIB;
o Has been denied/discontinued from UIB and
has no subsequent employment that would
change the UIB action; or
o Is participating in a strike.
Can aid be approved before the applicant/
participant applies for Unemployment Insurance
Benefits (UIB) or Disability Insurance Benefits
(DIB)?
Approval/authorization of aid should not be delayed
pending proof of applying for or the receipt of
UIB/DIB. The following documentation is
acceptable:
• An Affidavit (PA 853) from the applicant/
participant stating that he/she applied for
UIB/DIB may be accepted in lieu of verification
from EDD; or
• A completed CW 2201, Unemployment
Insurance Benefits Referral form, returned to the
EW by the applicant/participant, is considered
verification that this condition of eligibility has
been met.
What action is taken when an
applicant/participant refuses to apply for
Unemployment Insurance Benefits (UIB)?
Aid must be denied or discontinued when an
applicant/participant who has been referred to
