NOTE 6.- The Head of a circle has discretionary power to sanction payment of interest on<br />
the Savings Bank account of a deceased minor depositor, after the date on which the minor would<br />
have attained majority had he (or she) lived.<br />
64. Applications for withdrawal from depositors who have left <strong>India</strong>. – If a depositor,<br />
who has left <strong>India</strong> and is residing in a country with which there is no money order exchange, sends<br />
his pass-book with a letter applying for the withdrawal of money from his account, the orders of<br />
the Head of the Circle are necessary before the withdrawal can be granted. The orders should<br />
specify the manner in which the remittance is to be made. The actual cost of remittance should be<br />
deducted from the amount withdrawn.<br />
65. <strong><strong>Post</strong>al</strong> Certificates held by lunatics. – (1) When postal certificates stand in the name<br />
of a lunatic, who is incapable of managing his affairs, the Head of the Circle may allow the father<br />
or, if he be dead, the mother of the lunatic to discharge them, if the nominal value does not exceed<br />
five thousand rupees.<br />
(2) When the applicant for payment is neither the father nor the mother of the lunatic, and<br />
when the value of the postal certificates does not exceed five thousand rupees, the Head of the<br />
circle may sanction payment on production of a certificate by the Magistrate of the district in<br />
which the lunatic ordinarily resides, to the effect, that the applicant is the actual guardian of the<br />
lunatic.<br />
(3) If the value of the postal certificates exceeds five thousand rupees, payment shall not be<br />
made unless and until the applicant for payment shall have produced evidence to the satisfaction of<br />
the Head of the circle that he is the legal guardian of the lunatic.<br />
65/1. Transfer of <strong><strong>Post</strong>al</strong> Certificates held by a minor to the name of another person.-<br />
The Head of the circle may sanction the transfer of a <strong><strong>Post</strong>al</strong> Certificate standing in the name of a<br />
minor to that of another person without insisting on the production of proof of necessity from a<br />
Court of law in cases where the guardian of the minor holder applying for the transfer is a parent or<br />
a very near relative.<br />
66. Payment of <strong><strong>Post</strong>al</strong> Certificates standing in the names of deceased persons. – (1)<br />
Applications for payment of postal certificates standing in the names of deceased holders, will be<br />
submitted by postmaster for the orders of the Head of the circle with a report, in form c.c.-16<br />
accompanied by any documents produced by the applicant in support of his claim, except in cases<br />
in which the postmaster himself is competent to decide the claim. In disposing of the application<br />
the Head of the Circle giving orders for payment should be guided by the provisions of Rule 63.<br />
Orders for payment of postal certificates left by a deceased holder should be issued by the Head of<br />
the Circle in which at least one of those postal certificates stands registered. On receipt, therefore,<br />
of the application and other documents if the Head of the Circle finds that none of the postal<br />
certificates left by the deceased holder stands registered at any post office in his Circle he should<br />
arrange to obtain orders for payment from the Head of the proper circle.<br />
(2) The payment of cash certificates belonging to deceased joint holders will be regulated<br />
by the provisions of Rule 550(4) of the <strong>Post</strong>s and Telegraphs <strong>Manual</strong>, <strong>Vol</strong>ume VI.<br />
(3) If the title of the applicant is admitted and he desires to receive payment of the amount<br />
immediately, it should be sanctioned on the certificate standing in the name of the deceased<br />
investor. The applicant should, however be informed that he is not required to receive payment of<br />
the amount due before the certificate has reached maturity. If the applicant desires to hold the<br />
