TRANSPORT OF DANGEROUS GOODS AND RISK MANAGEMENT 154Planning is an important aspect of risk management, especially in emergency situations since an emergencysituation per se is a special kind of risk. On the one hand, planning prevents wrong actions, and on the other hand, itreduces the number of unused options, which is of great importance in the process of managing emergencysituations.Planning for emergency situations is the process of adopting and implementing procedures to identify predictableemergency situations using system analysis, preparation, testing and revision of the plan of response to anemergency situation. 1Risk management involves a set of policies and procedures of prevention, preparedness, response to accidents, aswell as the remedy of consequences of the accident in order to reduce risk and create the conditions under which therisk may be acceptable.Prevention (Mitigation) is a set of measures aimed at the prevention of emergency situations, reduction of theprobability of occurrence and minimization of the consequences. In the prevention stage, the priority role belongs tostrengthening legislation and harmonization with the EU legislation, and therefore further activities are proposed toeliminate the possibility of an emergency situation occurring, so that the risk was acceptable. This includesundertaking the preventive measures as well as defining the contents of plans of protection from emergencysituation, while making plans for the protection provides for the organization and preparation of all subjects,equipment and technical support for an adequate response with minimal consequences.Preparedness (Preparedness) is aimed at undertaking the necessary measures in case of activities related to thestage of prevention yield no results, especially when there is a real danger of an emergency situation occurring. Thisstage generally involves several important actions: putting the response plans into use, training agencies andauthorities (fire-fighting brigades, the Centre for Control of poisoning, mobile toxicological laboratories, centres forinformation and other institutions or their parts related to the response to an emergency situation), activation andtesting of alarm systems, deployment of standby teams of emergency medical assistance and the like.Response includes activities related to the risky situation, and the task at this stage is to isolate, and stop or limit thesecondary or subsequent effects of an emergency situation and to minimize the consequences. The procedureincludes a set of measures and actions taken based on the results of the stages of analyses of vulnerabilities and riskassessment in accordance with the plan of protection. The response procedure begins when the first pieces ofinformation about the accident are received, the information about the place and time of accident, type of hazardoussubstances present, as well as the estimates concerning the course of accident, risks for the environment, scope ofaccident and consequences and other important data. The accident response procedure must be conducted inaccordance with the situation on the ground and according to the predetermined plan of protection at the scene ofthe accident, and therefore the definition of stakeholders (relevant authorities and institutions) in this stage is a verycomplex issue and requires rather a serious approach.Recovery includes a set of activities for elimination of consequences caused by emergency situations, as well ascustomizing the space affected by accidents to its original purpose. In extraordinary situations, the organization and tasks of law enforcement agencies result fromthe solutions that are provided for by the Constitution, laws and regulations which set out the competencies andscope of work of these bodies.The main tasks of the police units in case of emergency, in order to protect the civilian population, material andcultural assets consist of the following:achieving the security of citizens, in other words carrying out police activities in the maintenance andprotection of public peace and order;protection of lives and property by combating crime;carrying out other tasks of public security by which various forms of danger and threats to civilians,material and cultural goods are observed and suppressed;participation in the implementation of protection and rescue tasks, providing assistance to citizens and stateorgans, and establishing cooperation, coordination and interaction with other subjects of security, defence and other. 1LEGAL REGULATIONS COVERING EMERGENCY SITUATION MANAGAMENT IN THEREPUBLIC OF SERBIABy adopting a set of laws governing the field of emergency situations, the problems of outdated legislation whichhas led to anomalies in the functioning and lack of coordination of services in response to emergency situation hasbeen overcome. Previous experience in this area has shown that the existing organizational framework of protectionand rescue in the Republic of Serbia was governed by a large number of anachronistic rules which provided forcontradictory decisions and for the implementation of which in practice a large number of various governmentbodies has been in charge.The “heap of rules” in this area further resulted in dispersion of energy and power it included, and there was anetwork of dysfunctional organs, bodies and units set which was insufficiently operational within the system.Namely, in addition to jurisdiction of the Ministry of the Internal Affairs, the Ministry of Defence was also incharge of the civil defence as defined in Chapter VII of the Law on Defence of the RS.Furthermore, the field of flood protection was in charge of the Ministry of Agriculture, Forestry and WaterManagement, and within the Ministry the Directorate for water management, while the protection from thechemicals, waste and harmful substances in the production, trade, transport, storage and disposal was theresponsibility of the Ministry of Environment and Regional Planning – the Administration for the Protection ofNatural Resources and the Environment within this Ministry.1Talijan M., Keković, Z., „Internal Affairs and preventive evacuation“, Proceedings of the Faculty of defense and protection,Belgrade 1999, pp. 131.
