TRANSPORT OF DANGEROUS GOODS AND RISK MANAGEMENT 156In order to overcome the resulting interregnum and achieve the more efficient organization, taking into account thepositive experiences in the world in this field, the Ministry of the Interior of the Republic of Serbia has defined thenew field of work entitled "The protection and rescue."The main objective is to integrate all activities aimed to protect life, health and property of citizens, to preserve theconditions necessary for life and to prepare for coping with the situation in terms of fires, natural disasters, theeffects of hazardous substances and other conditions of danger. In this way, the responsibility towards the citizensand their representative bodies for the state of protection and action in these situations is also defined.Further specification followed the adoption of the Decision of the Government of the Republic of Serbia datedMarch 05, 2009, in which it was decided to change the internal organization of the Ministry of the Interior of theRepublic of Serbia and to form a united Department of Emergency Situations. It is an organizational unit of the RSMinistry of the Interior established by merging the Administration of the Emergency Situations of the Ministry ofDefense and the former Department for the protection and rescue of the Ministry of the Interior, which nowrepresents a special-purpose service for the efficient and adequate response in case of floods, fires or other naturaldisasters. The purpose of establishing of the Division is in coordination of activities and united action with otherpublic bodies in order to achieve better results. 1Internal legal sources are certainly the most important legal basis for the work and actions in each specialized area,and can be considered within the context of presentations on emergency situations management and preventiveaction. 2The Constitution of the Republic of Serbia is undoubtedly the highest and most general legal act of the country,according to which the jurisdiction of the Republic has been established in Article 97. Thus it stipulates that theRepublic of Serbia regulates and provides for, among other things, the following questions:sovereignty, independence and territorial integrity of Serbia and its international position and relations withother countries and international organizations,the exercise and protection of freedoms and rights of a man and a citizen,the constitutionality and legality,defence and security of the Republic of Serbia and its citizens,measures in case of state of emergency,the system of protection and improvement of the environment, the system of protection and improvement of plant and animal life, etc. 3Bearing in mind that the emergency situations are a special security problem, the regulations determine the tasks oflaw enforcement agencies related to the protection of life, personal and proprietary safety of citizens (the preventionand remedy); the activities of protection from fire, explosions, spills of hazardous substances; combatingenvironmental crime; security and inspection of manufacturing, trading and transportation of explosive substances,1Conclusion of the Government of the RS, March 05, 2009. TRANSPORT OF DANGEROUS GOODS AND RISK MANAGEMENT 157flammable liquids and gases, traffic safety, criminal and technical investigation of accidental events, maintenance ofpublic peace and order; offering assistance to relevant authorities in the execution and implementation of measuresfor protection from accidents and repair consequences of accidents.Legal regulations which are of primary importance in the field of management in emergency situations and detailsgoverning this area are:Law on Ministries,Law on Police,Law on Emergency Situations,Law on Protection from Fire,Law of Explosive Materials, Inflammable Liquids and Gases,Law on Transfer of Explosives,Law on the Transport of Dangerous Substances, and others.In the Republic of Serbia the Ministries are responsible for the work related to state administration established bylaws and regulations adopted under the laws. They apply laws and other regulations and general acts of the SerbianParliament and Government, as well as general acts of the President of the Republic of Serbia, manage theadministrative matters, carry out administrative supervision over the performance of delegated tasks and others.Internal affairs tasks are the tasks determined by law the performance of which the authorized republic bodiesachieve security of the Republic of Serbia and its citizens and ensure the realization of the Constitution and otherlegally established rights of citizens.Law on Ministries of the Republic of Serbia 1 defines that the Ministry of the Interior conducts affairs of stateadministration with regard to “protection of life, personal and proprietary safety of citizens, providing assistance incase of danger, traffic and transport of weapons, ammunition, explosives and certain other hazardous substances,examination of small firearms, devices and ammunition, fire protection.” This law has enabled the establishing ofthe Ministries, their specific organization and scope of work. Also, this law stipulates that state administration lineof work related to the assistance in case of emergency and fire protection is carried out by the Ministry of theInterior (Article 5). In addition to this, in connection with these activities the Ministry of the Interior carries outother works related to trade and transport of weapons, ammunition, explosives and certain other hazardoussubstances.Law on Police 2 is designed so that the police operations are carried out as united in the Republic of Serbia. This lawcreates the legal assumptions for further reform of the police which are consistent with the best European traditionand contemporary international and comparative legal sources underpinning the police in a democratic society.By passing this law the conditions have been created for establishing new concept of public security and the legalcommitment to provide security protection for all who are at the territory of the Republic of Serbia, not only for itscitizens (citizens of Serbia). This protection is broader and more diverse and is based on the provision of severaltypes of assistance, the introduction of rescue functions, and other human interventions.Law on Police stipulates the obligations regarding the cooperation with all stakeholders in the interest of safety ofpersons and the self-organized individuals to protect the lives and safety of people at all times. Thus, police officersprotect public safety regardless of whether it is a risk to human life and property caused by natural disasters,epidemics and other forms of danger or the suppression of a criminal offense.
