Legal Expenses and Obligations<br />

2.11 <strong>Council</strong> shall, if requested, indemnify or reimburse the reasonable legal<br />

expenses <strong>of</strong>:<br />

• a <strong>Council</strong>lor defending an action arising from the performance in good<br />

faith <strong>of</strong> a function under the Act; or<br />

• a <strong>Council</strong>lor defending an action in defamation provided the statements<br />

complained <strong>of</strong> were made in good faith in the course <strong>of</strong> exercising a<br />

function under the Act; or<br />

• a <strong>Council</strong>lor for proceedings before the Local Government Pecuniary<br />

Interest and Disciplinary Tribunal or an investigative body provided the<br />

subject <strong>of</strong> the proceedings arises from the performance in good faith <strong>of</strong> a<br />

function under the Act and the Tribunal or investigative body makes a<br />

finding substantially favourable to the <strong>Council</strong>lor.<br />

Legal expenses incurred in relation to proceedings arising out <strong>of</strong> the<br />

performance by a <strong>Council</strong>lor <strong>of</strong> his or her functions under the Act shall be<br />

distinguished from expenses incurred in relation to proceedings arising<br />

merely from something that a <strong>Council</strong>lor has done during his or her term in<br />

<strong>of</strong>fice. For example, expenses arising from an investigation as to whether a<br />

<strong>Council</strong>lor acted corruptly by using knowledge <strong>of</strong> a proposed rezoning for<br />

private gain is not covered by this provision.<br />

<strong>Council</strong> shall not meet the costs <strong>of</strong> an action in defamation taken by a<br />

<strong>Council</strong>lor as plaintiff in any circumstances and shall not meet the costs <strong>of</strong> a<br />

<strong>Council</strong>lor seeking advice in respect <strong>of</strong> possible defamation, or in seeking a<br />

non-litigious remedy for possible defamation.<br />

<strong>Council</strong> shall not meet the costs <strong>of</strong> any enquiry, investigation or hearing<br />

initiated at the request <strong>of</strong>, or to any legal proceedings taken by, <strong>Council</strong> itself.<br />
