amendments to drafting which had no bearing on the Plan content. Subject to the proposed<br />

grammatical revision the Parliamentary Counsel advises that the Plan can be legally made.<br />

The Parliamentary Counsel revision is entirely consistent with <strong>Council</strong>’s exhibited plan and no<br />

objection is raised.<br />

FINANCIAL CONSIDERATIONS<br />

Work undertaken on the rezoning and DLEP relates to the use <strong>of</strong> staff resources and the costs <strong>of</strong><br />

advertising.<br />

CONSULTATION WITH OTHER COUNCIL DEPARTMENTS<br />

There has been no specific consultation with other departments since preparation <strong>of</strong> the Draft Plan<br />

having regard for its limited scope.<br />

SUMMARY<br />

1. DLEP211 has been publicly exhibited in accordance with statutory requirements and no<br />

submissions were received.<br />

2. No objections have been raised to the DLEP from the three (3) <strong>Council</strong>s who responded to the<br />

Section 62 Notification.<br />

3. The Draft Plan will rationalise the zoning <strong>of</strong> National Park lands such that the 6(a) zone is<br />

now made relevant. There are no implications for 6(a) zoned land outside <strong>of</strong> National Parks.<br />

4. Parliamentary Counsel has issued an opinion that DLEP211 may be legally made.<br />

5. To progress the matter <strong>Council</strong> will need to adopt the Plan and forward it together with a<br />

Section 69 Report to the Minister, requesting the making <strong>of</strong> the Plan.<br />

6. It is recommended that <strong>Council</strong> adopt the Plan and forward it to the Department <strong>of</strong> Planning<br />

with a request for its processing and gazettal by the Minister.<br />

RECOMMENDATION<br />

A. That <strong>Council</strong> adopt Draft Local Environmental Plan No 211 embodying the minor<br />

Parliamentary Counsel amendments.<br />

B. That Draft Local Environmental Plan No 211 as adopted together with the <strong>Council</strong><br />

Planning report be forwarded to the Department <strong>of</strong> Planning in accordance with<br />

Section 68(4) <strong>of</strong> the Environmental Planning and Assessment Act 1979.<br />
