94. A CASH BOND/BANK GUARANTEE <strong>of</strong> $10 000 shall be lodged with <strong>Council</strong> as a<br />

Landscape Establishment Bond prior to release <strong>of</strong> the Construction Certificate to ensure that<br />

the landscape works are installed and maintained in accordance with the approved landscape<br />

plan/s and other landscape conditions.<br />

Fifty percent (50%) <strong>of</strong> this bond will be refunded upon verification by <strong>Council</strong> that the<br />

landscape works as approved have been satisfactorily installed. The balance <strong>of</strong> the bond will<br />

be refunded 3 years after the initial satisfactory inspection, where landscape works have been<br />

satisfactorily established and maintained.<br />

It is the responsibility <strong>of</strong> the applicant to notify <strong>Council</strong> in relation to the refunding <strong>of</strong> the<br />

bond at the end <strong>of</strong> the 3 year period. Where a change <strong>of</strong> ownership occurs during this period it<br />

is the responsibility <strong>of</strong> the applicant to make all arrangements regarding transference <strong>of</strong> the<br />

bond and to notify <strong>Council</strong> <strong>of</strong> such.<br />

95. The applicant must apply to <strong>Council</strong> or an Accredited Certifier for a Construction Certificate<br />

to carry out the relevant building works that are approved by this consent. The details to be<br />

included in the Construction Certificate Application are:<br />

a) A set <strong>of</strong> architectural plans and specifications complying with the development consent<br />

plans, conditions and the Building Code <strong>of</strong> Australia.<br />

b) If the application for the Construction Certificate is with <strong>Council</strong> you will have to<br />

submit engineering details for all structural elements i.e. Piers, footings, reinforced<br />

concrete slab, first floor joist layout, ro<strong>of</strong> trusses layout, bracing and hold down details,<br />

steel beams etc, where relevant, for approval. A practising consulting structural<br />

engineer must prepare the details.<br />

c) A plan indicating the location <strong>of</strong> smoke alarm installation for the proposed<br />

development.<br />

d) Details <strong>of</strong> proposed termite treatment for the proposed development.<br />

e) Essential services plan outlining the existing and proposed fire safety measures.<br />

f) Disable access provisions to common and public areas in accordance with AS1428 parts<br />

1-4 inclusive.<br />

NOTE<br />

Should any alternative solution to satisfy the performance requirements <strong>of</strong> the Building Code<br />

<strong>of</strong> Australia for part <strong>of</strong> the Construction Certificate Application the following is to be meet:<br />

Assessment methods used to determine compliance with the performance requirements,<br />

including if and how each performance objective impacts on other requirements <strong>of</strong> the<br />

Building Code <strong>of</strong> Australia; and<br />

A statement about the person who prepared the alternative solution, indicating qualification,<br />

experience, insurance details, and membership <strong>of</strong> an approved accreditation body.<br />
