This indicator highlights the level <strong>of</strong> disputation in the planning and development process. Most <strong>of</strong> these planning and development expenses involve<br />

Development Applications, with other costs including enforcement and building matters.<br />

Ku-ring-gai is ranked the highest in this category when compared to Group 3 <strong>Council</strong>s and the highest compared to neighbouring <strong>Council</strong>s. Ku-ring-gai’s large<br />

number <strong>of</strong> Land and Environment Court matters contributes most significantly to legal costs in this area. <strong>Council</strong>’s legal expenses as a percentage to total planning<br />

and building control costs was 31.21%.<br />

Other factors which can affect this indicator are: the complexity <strong>of</strong> the legislation, level <strong>of</strong> compliance with development codes and plans, level <strong>of</strong> scrutiny applied<br />

to inspections and the level <strong>of</strong> community consultation in the formulation <strong>of</strong> policies.<br />
