There are no other matters for consideration.<br />

CONCLUSION<br />

Having regard to the provisions <strong>of</strong> section 96 and section 79C <strong>of</strong> the Environmental Planning and<br />

Assessment Act 1979, the proposed modification is considered to be satisfactory. Therefore, it is<br />

recommended that the application be approved.<br />

RECOMMENDATION<br />

Pursuant to Section 96 <strong>of</strong> the Environmental Planning and Assessment Act, 1979<br />

THAT the <strong>Council</strong>, as the consent authority, modify development consent to DA 1285/04, for<br />

demolition <strong>of</strong> 4 dwellings and the construction <strong>of</strong> a residential flat building containing 23 units and<br />

basement car parking for 52 vehicles on land at 9 to 15 Kings Avenue, Roseville, in the following<br />

manner:<br />

1. Condition No 1 is modified so as to read as follows:<br />

The development must be carried out in accordance with plans identified within the following<br />

table, and endorsed with <strong>Council</strong>’s approval stamp, except where amended by the following<br />

conditions:<br />
