All likely impacts have been assessed elsewhere in the report and are considered acceptable, subject<br />

to conditions.<br />

SUITABILITY OF THE SITE<br />

The site is suitable for the proposed development.<br />

ANY SUBMISSIONS<br />

All submissions received have been considered in the assessment <strong>of</strong> this application.<br />

PUBLIC INTEREST<br />

The approval <strong>of</strong> the application is considered to be in the public interest.<br />

OTHER RELEVANT MATTERS<br />

There are no other matters for consideration.<br />

CONCLUSION<br />

Having regard to the provisions <strong>of</strong> Section 79C <strong>of</strong> the Environmental Planning and Assessment Act<br />

1979, the proposed development is considered to be satisfactory. Therefore, it is recommended that<br />

the application be approved.<br />

RECOMMENDATION<br />

Pursuant to Section 80(1) <strong>of</strong> the Environmental Planning and Assessment Act, 1979<br />

THAT the <strong>Council</strong>, as the consent authority, grant development consent to DA 826/06 for<br />

demolition <strong>of</strong> two dwelling houses and construction <strong>of</strong> a residential flat building on land at 20-22<br />

Tryon Road, Lindfield, for a period <strong>of</strong> two (2) years from the date <strong>of</strong> the Notice <strong>of</strong> Determination,<br />

subject to the following conditions:<br />

GENERAL CONDITIONS<br />

1. The development must be carried out in accordance with plans identified within the following<br />

table and endorsed with <strong>Council</strong>’s approval stamp, except where amended by the following<br />

conditions:<br />
