ANALYSIS OF LAND & ENVIRONMENT COURT COSTS -<br />
2ND QUARTER 2006/<strong>2007</strong><br />
EXECUTIVE SUMMARY<br />
PURPOSE OF REPORT:<br />
To provide information in relation to<br />
proceedings to which <strong>Council</strong> is a party in the<br />
Land & Environment Court for the quarter<br />
ended 31 December 2006, including appeals<br />
commenced, costs incurred by <strong>Council</strong> and<br />
outcomes.<br />
BACKGROUND:<br />
An applicant may commence proceedings in the<br />
Land and Environment Court for an application<br />
which has either been refused by <strong>Council</strong> or is<br />
deemed to have been refused. An appeal may<br />
also be commenced in relation to conditions in<br />
any consent granted by <strong>Council</strong>.<br />
COMMENTS:<br />
For the half year ended December 2006,<br />
<strong>Council</strong>’s legal costs and associated expenses in<br />
relation to Land & Environment Court matters<br />
were $382,100. This compares to the revised<br />
year to date budget <strong>of</strong> $800,000.<br />
RECOMMENDATION:<br />
That the analysis <strong>of</strong> Land & Environment Court<br />
costs for the second quarter ended December<br />
2006, be received and noted.<br />
