1.2.1.3. Other Laws and Regulations related to coastal activities<br />

Apart from the Coastal Regulation Zone notification, 1991 there are many legislations / acts and rules related to<br />

coastal activities. The following are the important ones:<br />

Indian Fisheries Act, 1897; Indian <strong>Port</strong>s Act, 1902; Merchant Shipping Act, 1974, Wildlife (Protection) Act<br />

1972; Water (Prevention and Control of Pollution) Act, 1974, Air (Prevention and Control of Pollution) Act,<br />

1981; Indian Coast Guards Act, 1974; and Maritime Zones of India (Regulation of Fishing by Foreign Vessels)<br />

Act, 1981; Environment (Protection) Act 1986; The Petroleum Act, 1934; National Environment Tribunal Act,<br />

1995; Hazardous Wastes (Management and Handling) Rules, 1989.<br />

In addition to this, India has signed and ratified several international conventions relating to oceans and related<br />

activities. Some of these are related to marine environment and applicable to coastal area also. The important<br />

ones are: MARPOL 1973/1978; London Dumping Convention, 1972; Convention on Civil Liability for Oil<br />

Pollution Damages (CLC 1969) and its Protocol, 1976; Fund, 1971 and its Protocol, 1979; CITES, Convention<br />

on Biodiversity, 1992.<br />

1.2.1.4. Coastal Zone Management Authority<br />

The Government of India, MoEF has constituted an authority namely, the Tamil Nadu Coastal Zone<br />

Management Authority, to enforce the Coastal Regulation Zone notification. The Chairman of the Authority is the<br />

Secretary to Government, MoEF and the Director, Department of Environment is the Member Secretary.<br />

1.3. INITIAL ENVIRONMENTAL EXAMINATION<br />

The present study deals with the Environmental issues related to the Project in order to assess the likely impact.<br />

IEE has been conducted within the short time available. The study mainly depends on secondary data on<br />

physiological condition of the area. Some field verifications have been undertaken by the study team for<br />

updating the secondary data when it was necessary.<br />

IEE was carried out as part of this TEFR. Thus it can assure that the Project will be environmentally feasible. The<br />

general objectives of IEE study had cover the following:<br />

• To provide information about the general environmental settings of the project area as baseline data.<br />

• To provide information on potential impacts of the project and the characteristic of the impacts,<br />

magnitude, distribution and their duration.<br />

• To provide information on potential mitigation measures to minimize the impact including mitigation costs.<br />

• To provide basic information for formulating management and monitoring plan.<br />

The indicative outline of the present IEE report is as follows:<br />

• A. Introduction.<br />

• B. Description of the Project.<br />

• C. Description of the Environment.<br />

• D. Screening of Potential Environmental Impacts and Mitigation Measures.<br />

• E. Institutional Requirements and Environmental Management Plan.<br />

• F Conclusions.<br />
