47. A working smoke-detection system, approved by the state or local<br />

fire marshal, must be installed in the child-care center (§746.5313).<br />

This system may be an electronic alarm and smoke-detection system,<br />

or individual electric or batter-operated smoke detectors located<br />

in each room use by children, or both (§746.5311).<br />

48. Each child-care center must be equipped with a working carbon<br />

monoxide detection system (§746.5531). System must be individual<br />

electric (plug-in or hardwire) or battery-operated carbon monoxide<br />

detectors that is UL-listed OR an electronic carbon monoxide<br />

detection system connected to an electronic alarm/smoke detection<br />

system that is UL-listed (§746.5533).<br />

If an electric or batter-operated detector is utilized, at least one<br />

must be installed on every level <strong>of</strong> each building in the child-care<br />

operation and must be installed in compliance with the state or<br />

local fire marshal’s instructions (§746.5535).<br />

If an electronic detection system connected to an alarm/smoke<br />

detection system is utilized, the system must be installed according<br />

to the state or local fire marshal’s instructions (§746.5535).<br />

49. It is not a requirement that the child-care center provide transportation<br />

to/from the facility. However, should the user decide to pursue<br />

this route, transportation is required to be licensed and regulated<br />

as per the minimum standards, Subchapter X, ‘Transportation,”<br />

Section 746.5601 through 746.5621.<br />

Texas Education Code<br />

<strong>The</strong> Texas Education Code (TEC), as established by the Texas Legislature,<br />

is a set <strong>of</strong> the state laws which govern public education in Texas. All educational<br />

institutions supported in part or whole by state tax funds are<br />

required to meet these statues, unless specifically excluded by the code.<br />

As it is neither a public, independent school district (ISD) or charter<br />

school, the <strong>Pre</strong>-K 4 <strong>SA</strong> project is not required to meet the requirements<br />

<strong>of</strong> the TEC. According to the TEC (Title 2, Chp.29, Subchapter E,<br />

Sec.29.1532), should the local school districts decide to contract with the<br />

<strong>Pre</strong>-K 4 <strong>SA</strong> child-care centers to provide pre-kindergarten services to their<br />

students, the program must, at a minimum, comply with the applicable<br />

child-care licensing standards adopted by the Department <strong>of</strong> Family and<br />

Protective Services under Chapter 42, Section 42.042, Texas Human<br />

Resources Code (September 2011). <strong>The</strong>se minimum standards which the<br />

child-care center must meet have been outlined in the previous section.<br />

Although it is not required to meet the TEC requirements <strong>for</strong> a pre-kindergarten<br />

facility, according to discussions with the Texas Education Agency<br />

(TEA), should the <strong>City</strong> decide to <strong>of</strong>fer space to public school children<br />

at its facilities, it is required the proposed <strong>Pre</strong>-K 4 <strong>SA</strong> Centers provide<br />

the minimum 36 square foot per child indoor activity area required by<br />
