7. Tuition based pre-kindergarten classes may be <strong>of</strong>fered if the district<br />

provides an additional half-day <strong>of</strong> pre-kindergarten classes to those<br />

eligible <strong>for</strong> free pre-k and half-day and full-day classes to those which<br />

are not (Title 2, Chp. 2, Subtitle F, Chp. 29, Sec.29.1531).<br />

8. A school district’s pre-kindergarten program shall be designed to<br />

develop skills necessary <strong>for</strong> success in the regular public school curriculum,<br />

including language, mathematics, and social skills (Title<br />

2, Chp. 2, Subtitle F, Chp. 29, Sec.29.1532).<br />

9. A library is not a requirement at the pre-kindergarten level. A school<br />

district shall consider the standards <strong>of</strong> the Texas State Library and<br />

Archives Commission in developing, implementing, or expanding<br />

library services (Title 2, Chp. 2, Subtitle F, Chp. 33, Sec.33.021).<br />

10. Provide at least one automated external defibrillator on campus.<br />

Consider the primary location to be where students engage in athletic<br />

activities (Title 2, Subtitle G, Chp. 38, Sec.38.017; Sec. 779.001,<br />

Health and Safety Code).<br />

11. Visitors to the campus may be required to display the person’s<br />

driver’s license or another <strong>for</strong>m <strong>of</strong> identification containing the person’s<br />

photograph issued by a governmental entity (Title 2, Subtitle<br />

G, Chp. 38, Sec. 38.022).<br />

12. A school district that constructs a new instructional facility or conducts<br />

a major renovation <strong>of</strong> an existing instructional facility using<br />

funds allotted to the district under this subchapter shall consider,<br />

in the design <strong>of</strong> the instructional facility, security criteria developed<br />

by the Texas School Safety Center under Section 37.2051 (Title 2,<br />

Subtitle I, Chp. 46, Sec. 46.0081) <strong>for</strong> emergency preparedness.<br />

Texas Health and Safety Code<br />

<strong>The</strong> following requirements related to school buildings and grounds are<br />

stated in Title 5, Chp. 341, Sec. 341.065 <strong>of</strong> the State <strong>of</strong> Texas Health and<br />

Safety Code:<br />

1. A school building must be located on grounds that are well drained<br />

and maintained in a sanitary condition.<br />

2. A school building must be properly ventilated and provided with<br />

an adequate supply <strong>of</strong> drinking water, an approved sewage disposal<br />

system, hand-washing facilities, a heating system, and lighting facilities<br />

that con<strong>for</strong>m to established standards <strong>of</strong> good public health<br />

engineering practices.<br />
