This unit introduces students to the fundamental principles<br />

which form the basis of systems and processes of Australian<br />

government at federal and state levels, including an exploration<br />

of alternative systems of government found in other jurisdictions.<br />

The unit also critically examines the role of government<br />

in policy development, in making and administering<br />

the law, and in the operation of specific public laws, such as<br />

freedom of information, privacy laws and anti-discrimination<br />

laws. The unit aims to provide students with a knowledge of<br />

political and legal issues crucial to their participation as professionals<br />

in the justice system.<br />

■ JSB018 CRIMINOLOGY 1<br />

This unit traces the development of theories of criminal behaviour<br />

and criminal law from the Enlightenment to the present<br />

day. Examination will also be made of the impact criminological<br />

theory has upon institutional practices within the criminal<br />

justice system.<br />

■ JSB021 CRIMINOLOGY 2<br />

Examination of the theories of punishment. Having defined<br />

punishment and the nature and limits of the criminal law, students<br />

assess the traditional justifications for punishment: retribution<br />

and just deserts, deterrence, rehabilitation and elimination<br />

and incapacitation. Justifications for severity of punishment,<br />

the control of judicial discretion and the political<br />

significance of punishment are examined. Options for reform<br />

are also canvassed.<br />

This subject exposes students to fundamental principles of<br />

criminal law as well as the social and political forces that shape<br />

those laws. It focuses on crimes of violence including sexual<br />

assault, child abuse, elder abuse and domestic violence. It also<br />

looks at criminal defences and property offences.<br />

JUSTICE PROCESS 1<br />

The human factors involving personality, inheritance and moral<br />

development, and crime are explored in the context of policing,<br />

the courts and the correctional system. Eyewitness testimony,<br />

offender rehabilitation and societal reactions are examined.<br />

■ JSB024 PRINCIPLES OF CRIMINAL LAW 2<br />

This subject exposes students to fundamental principles of<br />

criminal law as well as the social and political forces that shape<br />

those laws in the areas of crimes of morality; drug, traffic and<br />

public order offences; war crimes and hate crimes; state corruption<br />

and whistleblowers; white collar crime, proceeds of<br />

crime and victims of crime. It also looks at the due process<br />

aspects of criminal procedure.<br />

■ JSB031 INVESTIGATION & EVIDENCE<br />

Professionals involved in the fields of law enforcement and<br />

justice administration are frequently required to exercise investigative<br />

skills. This unit provides students with a clear understanding<br />

of the law relating to the gathering of evidence,<br />

interrogation and admissibility of evidence in court. Study<br />

includes an examination of the general principles of judicial<br />

evidence, witnesses, rules of evidence, admissions and confessions.<br />

Issues of evidence of current importance (e.g. issues<br />

arising out of inquiries such as ‘Operation Trident’, new forms<br />

of evidence such as DNA, phone taps and the erosion of the<br />

right to silence) are also to be explored.<br />

■ JSB032 ALTERNATIVE JUSTICE PROCESSES<br />

The state approach to conflict and dispute resolution is explored,<br />

highlighting the differences between the institutionalised<br />

legal system and alternatives promised by other schemes.<br />

This subject takes both a theoretical and a practical focus,<br />

with skills training comprising an important part of tutorials.<br />

A critical examination of the policies, philosophy and the practice<br />

of dispute resolution is undertaken in order to best apprise<br />

justice professionals of their personal and professional<br />

options when faced by conflict.<br />

as a project work component on formulating your own position<br />

on accountable practices in a particular work context.<br />
