played by the Trade Practices Act in relation to conveyancing<br />

and land transactions, banking transactions and advertising.<br />

Unconscionable conduct is also considered. The second part<br />

of the unit is concerned with statutory and common law actions<br />

available when loss or damage is suffered as a result of<br />

defective products. Remedies and defences are considered<br />

■ LWN052 LITIGATION – CIVIL PROCEDURE<br />

Focus upon topics of current interest or difficulty in civil procedure.<br />

Supreme and Federal Court rules and practice directions<br />

are considered in the light of the theories of civil procedure<br />

and tactics involved in dispute resolution. Some principles<br />

of negotiation and alternative dispute resolution are also<br />

addressed. Participants will acquire an appreciation of the<br />

dynamics of the adversarial process and an understanding of<br />

selected principles of interlocutory disputes in the light of the<br />

tactics involved in an action as a whole. Offers an opportunity<br />

for students to deepen and broaden their legal education in a<br />

way related directly to professional practice.<br />

LEGAL ISSUES<br />

This unit examines the law and practice of contemporary commercial<br />

legal issues. Topics covered include: governmental<br />

trade practices liability, native title implications for financiers<br />

and landholders, third party securities (corporate and personal<br />

guarantees and mortgages), Australian foreign investment<br />

regulation, civil and criminal liability of directors and corporate<br />

advisers, corporate risk management programs, transactions<br />

and securities affecting personal property, international<br />

sale of goods contracts, fundraising and capital markets, internationalisation<br />

of Australian commercial law, civil and<br />

criminal liability of the crown and crown employees, clientbased<br />

research in commercial practice, and paradigm shifts<br />

in Australian law and their impact on commercial practice.<br />

The central principles concerning the protection of human<br />

and the public interest. Included are pollution control,<br />

environmental impact assessment, environmental management,<br />

conservation of the natural and cultural environments.<br />

The principles and concepts of natural resources law in<br />

operational objectives; an assessment of a number of developed<br />

and evolving mechanisms for achieving these objectives<br />

such as policy objectives, management plans, incentives and<br />

inducements, market instruments and property rights.<br />

Constitution; federal legislation dealing with offshore development,<br />

Standard contracts used in the Australian construction and<br />

advanced level; issues of drafting in relation to the relevant<br />

standard forms.<br />
