POLLUTION LAW<br />

The protection and preservation of the marine environment<br />

has developed into an important aspect of marine law. International<br />

conventions and agreements, combined with Commonwealth,<br />

state and territory legislation has resulted in a<br />

complex matrix of laws and practice. The subject is not being<br />

given the prominence in law studies that it now merits.<br />

The pollution of the sea is a major problem and a study of its<br />

legal regimes is beneficial towards addressing it.<br />

■ LWN085 INTERNATIONAL LAW OF THE SEA<br />

International law of the sea has always been of importance<br />

to island countries like Australia, but has taken an added<br />

importance with Australia’s added maritime jurisdiction of<br />

the 200 n.m. exclusive economic zone under the United<br />

Nations Convention on the Law of the Sea 1982. The focus<br />

of this unit will be the development of the law of the sea<br />

and a study of the current issues, with particular emphasis<br />

on the Australian, Southeast Asian and Pacific Ocean areas.<br />

■ LWN086 SELECTED ISSUES IN PRACTISING<br />

LAW<br />

The face of legal practice is changing constantly. Today there<br />

are many influences upon the practice of law. This is a time<br />

of assessing and reassessing the needs of the legal profession<br />

and of the client. Therefore it is timely to consider some<br />

of these important and contemporary issues. This unit seeks<br />

to address selected and topical aspects of practising law in<br />

the wider context as well as day-to-day.<br />

■ LWN087 CONTEMPORARY ISSUES IN TORTS<br />

Advanced level study of contemporary issues in torts enables<br />

a detailed consideration of selected matters at a time of<br />

great change in this area of the law. The practical, theoretical<br />

and comparative analysis of the selected issues will extend<br />

understanding of this fundamental and significant part<br />

of general legal practice and the inter-relationship with contiguous<br />

fields of legal principle.<br />

■ LWN088 GOVERNMENT LAW, POLICY &<br />

PRACTICE<br />

This unit examines key aspects of the law and policy-making<br />

process surrounding the development of legislation and<br />

the operation of government, especially in Queensland. Topics<br />

covered include: the internationalisation of Australian<br />

law and policy making, civil and criminal liability of the<br />

crown and crown employees, scrutiny of legislation (including<br />

Queensland’s “fundamental legislative principles”),<br />

grounds for challenging legislation, crown immunity, government<br />

contract-making, native title law and practice for<br />

the public and private sectors, legal issues in government<br />

accountability, the role and function of key bodies in the<br />

executive and legislative arms of government, the governmental<br />

policy making process and governmental trade practices<br />

liability.<br />

■ LWN089 CURRENT LEGAL PROBLEMS<br />

AFFECTING SPORTS<br />

Sport and the law is a growing area of legal practice. The<br />

inter-relationship of the sporting culture, commercialised activities<br />

and a wide range of relevant legal areas provides a<br />

unique mix for the study of many overlapping areas of law<br />

and social policy. Topics covered include: liability of sports<br />

organisations and participants for injury or damage; legislative<br />

and common law intrusion onto the sporting field; construction,<br />

operation and maintenance of sports facilites; the<br />

right to control and sanction sport participants; securing<br />

sponshorship and endorsement rights; sports marketing and<br />

the exploitation of the intellectual and personal property of<br />

teams and atheletes; industrial relations and sport; broadcasting<br />

of sporting events; sports business and trade practices.<br />

■ LWN090 CORPORATE TAXATION<br />

Along with Taxation of Non-Corporate Entities dealing with<br />

partnerships and trusts, this one semester course considers<br />

the taxation of entities in a domestic setting in Australia<br />

(international issues are considered in Taxation of International<br />

Transactions). Corporate Taxation consists of a detailed<br />

consideration of the income and capital gains tax treatment<br />

of companies and shareholders in a context where companies<br />

are taxed on a separate basis from their shareholders<br />

but with an imputation system to reconcile in part the treatment<br />

of the company and the shareholders, compared to entities/owners<br />

which are currently taxed on a look through<br />

and/or proxy basis.<br />

■ LWN091 TAXATION OF NON-CORPORATE<br />

ENTITIES<br />

Along with Corporate Taxation, this one semester course considers<br />

the taxation of entities in a domestic setting in Australia<br />

(international issues are considered in Taxation of International<br />

Transactions). Taxation of Non-Corporate Entities<br />

consists of a detailed consideration of the income and capital<br />

gains tax treatment of partnerships and trusts in a context where<br />

entities/owners are taxed on a look through and/or proxy basis<br />

compared to companies that are currently taxed on a separate<br />

basis from their shareholders but with an imputation system.<br />

■ LWN092 AUSTRALIAN IMMIGRATION &<br />

CITIZENSHIP LAW<br />

The legal rules which form the backbone of Australia’s immigration<br />

regime continue to be of great importance commercially,<br />

socially and politically. Immigration law is becoming<br />

a specialist area, even more so since the introduction of the<br />

Migration Agent Registration Scheme. Topics covered in this<br />

course will include Australian citizenship; the immigration<br />

regime and functions under the Migration Act 1958 and the<br />

Migration Regulations, the role of Government Policies; permanent<br />

and temporary entry into Australia on family grounds,<br />

on employment grounds, with independent and concessional<br />

visas, relying on business skills, humanitarian entry; processing<br />

and other issues common to visa classes; unlawful persons;<br />

review of immigration and citizenship decisions; and<br />

Migration Agents Registration Scheme.<br />

■ LWN100 HONOURS DISSERTATION<br />

A dissertation by students enrolled in the Master of Laws by<br />

Coursework who have obtained 96 credit points with a GPA<br />

of 6 or better. The dissertation is between 20 000 and 30 000<br />

words in length.<br />
