Reasons that hastened the implementation of the Ethics<br />

Code in the banks<br />

– the particular importance of the activities developed by the<br />

banks and lending institutions;<br />

– the banks and the lending institutions must organize their<br />

activities in accordance with the rules of a prudential and<br />

healthy banking practice, for this having procedures and<br />

mechanisms to provide the identification and monitoring the<br />

risks they are, or could be exposed to;<br />

– the banks and the lending institution play an important<br />

intermediation role between the clients requesting funds and<br />

the clients placing funds, fact that leads to strictly respecting<br />

the banking ethics principles;<br />

– admitting the importance of respecting the social values of<br />

the human rights, of integrity, objectivity, social and corporate<br />

responsibility, trust, transparency, liberalization, protection of<br />

the confidential information, respecting the legal regulations in<br />

the field;<br />

Objectives<br />

– to promote an adequate behaviour for<br />

the employees in the lending institutions<br />

towards the clients, authorities, banking<br />

environment, the business community,<br />

colleagues, etc.;<br />

– to strengthen the clients’ trust in the<br />

financial-banking system, as a whole;<br />

– to promote the public image according<br />

to which the lending institutions and the<br />

banking staff offer high quality products<br />

and services to their clients;<br />

– to promote the public image according<br />

to which the lending institutions and the<br />

and services to their clients;<br />

– aiming to create an instrument to support the balance among<br />

the clients’ interests, the lending institutions’ interestes and also<br />

their shareholders’;<br />

– to support a fair competition on the<br />

financial – banking market, according to<br />

the market conditions;<br />

The Banking Ethics Code is applied to all the banks and lending institutions, that are members<br />

to the Romanian Banking Association (ARB). The stipulations of the Banking Ethics<br />

Code, transposed into internal rules for the ARB member institutions, are mandatory for all<br />

the persons that develop their activities within lending institutions. The stipulations of the<br />

Banking Ethics Code, mainly refer to the relation between the banks, lending institutions and<br />

their clients, the relation between the banks and authorities, the relation among the lending<br />

institution, the relation between the banks and employees, and finaly to the relation among<br />

the employees in the banks.<br />

The fundamental principles that must be respected by all the employees of the Romanian<br />

lending institutions in their professional relations with the clients or authorities, and also with<br />

the employees in the other lending institutions or inside, are the following:<br />

– the moral integrity, principle according to which the employees are forbidden to request<br />

or to accept, directly or indirectly, for them or for others, any advantage, benefit for their position<br />

or to abuse of such position in any way;<br />

– fairness and non-discrimination, principle according to which the employees in the banks<br />

and lending institutions are obliged to have an objective attitude, neutral towards any political,<br />

economic, religious interest or of any other nature, in performing the tasks related to<br />

their jobs;<br />

– confidentiality, principle that states the obligation for the employees of the banks and<br />

lending institutions, not to transmit confidential information about the facts, data and information<br />

that refer to the developed activity, and also to any facts, data or information con-
