BS2540 Legal Procedure and Evidence<br />

10 credit points 4 hours per week Hawthorn<br />

This is a second year subject of the Bachelor of Applied<br />

Science (Environmental Health)<br />

Content<br />

The legal process of prosecution - choosing the appropriate<br />

court, who may prosecute, the rule against ambiguous<br />

allegations; what must be specified in the information and<br />

summons; rules with respect to service and proof of same.<br />

Time limits. Adjournment;<br />

The civil and criminal trial process. Differences in trial<br />

procedures for summary and indictable offences. Pleas,<br />

examination of witnesses, powers of the court;<br />

The rules of evidence statutory and judicial developments,<br />

the burden and standards of proof, hearsay, documents,<br />

admissions, improperly obtained evidence, competent and<br />

compellable witnesses, expert witnesses, judicial notice and<br />

other relevant evidentiary issues will be considered;<br />

In the context of mock trials, which will commence from<br />

the initial interview of a complainant, particular problems<br />

relating to both procedure and evidence, sampling and entry<br />

powers will be considered;<br />

Particular problems caused by the concept of legal<br />

personality when prosecuting the corporate defendant and<br />

whether criminal sanctions are appropriate will be<br />

examined.<br />

BS428 Administration and Management<br />

This is a fourth year subject of the Bachelor of Applied<br />

Science (Environmental Health)<br />

Content<br />

An introduction to management theory and practice, with<br />

special reference to government agencies, which will build<br />

on the industry based learning experiences of<br />

Environmental Health students.<br />

The course will study recent changes in local government<br />

namely amalgamation, compulsory competitive tendering,<br />

enterprise bargaining, financial and resource management,<br />

and administrative procedures. The role of the<br />

environmental health officer will be examined in the light of<br />

these organisational changes.<br />

BS447 Administrative Law<br />

To consider efficient internal administrative procedures to<br />

ensure against liability for negligent advice.<br />

Regulatory controls - Statutory duties and liability for<br />

breach, effective administration procedures and alternatives<br />

in regulatory techniques.<br />

The role of the Ombudsman and Committees of Enquiry.<br />

The Administrative Law Act and review by courts and<br />

tribunals of the administrative process, the application of the<br />

rules of natural justice, notice and fair hearing, the duty to<br />

give reasons, impartiality and bias.<br />

Business Studies -Accounting<br />

Content<br />

The purpose of this course is to provide students with a<br />

workable knowledge of the accounting principles and<br />

concepts, with an understanding of how accounting<br />

information is reported and used in decision-making.<br />

On completion of this subject the students should be able to:<br />

Outline the major internal and external users of<br />

accounting - information;<br />

Explain how accounting information may be used to<br />

assist in ma kin^ - business decisions;<br />

Be able to prepare accounting reports - balance sheet,<br />

and profit and loss statements;<br />

Prepare a bank reconciliation statement and understand<br />

its role in cash control;<br />

Prepare a cash budgcet and cash flow statement;<br />
