STEP 10. HAVE THE CONTRACT SIGNED AND<br />

APPROVED<br />

1. LEGAL REFERENCE<br />

Section 37 <strong>of</strong> <strong>the</strong> revised IRR specifies <strong>the</strong> rules regarding contract signing and approval.<br />

2. PURPOSE<br />

This is <strong>the</strong> stage that <strong>the</strong> procuring entity now enters into an agreement with <strong>the</strong> HRRB to<br />

undertake <strong>the</strong> <strong>service</strong>s within <strong>the</strong> conditions and period set <strong>for</strong>th in <strong>the</strong> bidding. This is also <strong>the</strong><br />

stage when actual notice is given to HRRB to commence <strong>the</strong> project.<br />

3. RULES AND GUIDELINES<br />

3.1 Period <strong>of</strong> entering into a contract<br />

The winning bidder and <strong>the</strong> Procuring Entity must enter into a contract immediately after<br />

<strong>the</strong> <strong>for</strong>mer has submitted <strong>the</strong> per<strong>for</strong>mance security and all o<strong>the</strong>r documentary<br />

requirements within <strong>the</strong> period specified in <strong>the</strong> revised IRR. The parties must sign <strong>the</strong><br />

contract within ten (10) calendar days from receipt by <strong>the</strong> winning bidder <strong>of</strong> <strong>the</strong> NOA<br />

(Section 37.2 <strong>of</strong> <strong>the</strong> revised IRR).<br />

The Chief Accountant or <strong>the</strong> Chief Budget Officer may sign <strong>the</strong> contract as an instrumental<br />

witness <strong>the</strong>reto.<br />

The Procuring Entity signatory is encouraged to sign within <strong>the</strong> same day as <strong>the</strong> signing <strong>of</strong><br />

<strong>the</strong> bidder as <strong>the</strong>re are penalties against delaying, without justifiable cause, <strong>the</strong> award <strong>of</strong><br />

<strong>the</strong> contract (Section 65.1 <strong>of</strong> <strong>the</strong> revised IRR). Moreover, it would be best <strong>for</strong> <strong>the</strong> winning<br />

bidder and <strong>the</strong> HOPE, or its appropriate signing authority, to sign/execute <strong>the</strong> contract<br />

toge<strong>the</strong>r – provided that all contract documents and requirements are complete – so that<br />

both may personally appear be<strong>for</strong>e a Notary Public.<br />

3.2 Timelines <strong>for</strong> contract approval<br />

When, after contract signing, fur<strong>the</strong>r approval <strong>of</strong> a higher authority is required, <strong>the</strong><br />

approving authority <strong>for</strong> <strong>the</strong> contract, or his duly authorized representative, shall be given a<br />

maximum <strong>of</strong> fifteen (15) calendar days from receipt <strong>the</strong>re<strong>of</strong>, toge<strong>the</strong>r with all<br />

documentary requirements to perfect <strong>the</strong> said contract, to approve or disapprove it<br />

(Section 37.3 <strong>of</strong> <strong>the</strong> revised IRR).<br />

3.3 Effectivity <strong>of</strong> <strong>the</strong> contract<br />

Unless o<strong>the</strong>rwise specified in <strong>the</strong> contract, a contract is effective upon receipt <strong>of</strong> <strong>the</strong> NTP.<br />

If an effectivity date is provided in <strong>the</strong> NTP by <strong>the</strong> Procuring Entity concerned, which date<br />
